55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to health benefit plan coverage for certain tests to
88 detect prostate cancer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1362.001, Insurance Code, is amended to
1111 read as follows:
1212 Sec. 1362.001. APPLICABILITY OF CHAPTER. (a) This chapter
1313 applies only to a health benefit plan that[:
1414 [(1)] provides benefits for medical or surgical
1515 expenses incurred as a result of a health condition, accident, or
1616 sickness, including[:
1717 [(A)] an individual, group, blanket, or
1818 franchise insurance policy or insurance agreement, a group hospital
1919 service contract, or an individual or group evidence of coverage
2020 that is offered by:
2121 (1) [(i)] an insurance company;
2222 (2) [(ii)] a group hospital service corporation
2323 operating under Chapter 842;
2424 (3) [(iii)] a fraternal benefit society operating
2525 under Chapter 885;
2626 (4) [(iv)] a stipulated premium company operating
2727 under Chapter 884; [or]
2828 (5) [(v)] a health maintenance organization operating
2929 under Chapter 843;
3030 (6) an approved nonprofit health corporation that
3131 holds a certificate of authority under Chapter 844;
3232 (7) a multiple employer welfare arrangement that holds
3333 a certificate of authority under Chapter 846;
3434 (8) a Lloyd's plan operating under Chapter 941; or
3535 (9) an exchange operating under Chapter 942.
3636 (b) Notwithstanding any other law, this chapter applies to
3737 [and
3838 [(B) to the extent permitted by the Employee
3939 Retirement Income Security Act of 1974 (29 U.S.C. Section 1001 et
4040 seq.), a health benefit plan that is offered by:
4141 [(i) a multiple employer welfare
4242 arrangement as defined by Section 3 of that Act; or
4343 [(ii) another analogous benefit
4444 arrangement;
4545 [(2) is offered by]:
4646 (1) a small employer health benefit plan subject to
4747 Chapter 1501, including coverage provided through a health group
4848 cooperative under Subchapter B of that chapter;
4949 (2) a standard health benefit plan issued under
5050 Chapter 1507;
5151 (3) a basic coverage plan under Chapter 1551;
5252 (4) a basic plan under Chapter 1575;
5353 (5) a primary care coverage plan under Chapter 1579;
5454 (6) a plan providing basic coverage under Chapter
5555 1601;
5656 (7) group health coverage made available by a school
5757 district in accordance with Section 22.004, Education Code;
5858 (8) the state Medicaid program, including the Medicaid
5959 managed care program operated under Chapter 533, Government Code;
6060 (9) the child health plan program under Chapter 62,
6161 Health and Safety Code;
6262 (10) a regional or local health care program operated
6363 under Section 75.104, Health and Safety Code;
6464 (11) a self-funded health benefit plan sponsored by a
6565 professional employer organization under Chapter 91, Labor Code;
6666 and
6767 (12) a health benefit plan offered by [(A) an approved
6868 nonprofit health corporation that holds a certificate of authority
6969 under Chapter 844; or
7070 [(B)] an entity not authorized under this code or
7171 another insurance law of this state that contracts directly for
7272 health care services on a risk-sharing basis, including a
7373 capitation basis[; or
7474 [(3) provides health and accident coverage through a
7575 risk pool created under Chapter 172, Local Government Code,
7676 notwithstanding Section 172.014, Local Government Code, or any
7777 other law].
7878 SECTION 2. Section 1362.002, Insurance Code, is amended to
7979 read as follows:
8080 Sec. 1362.002. EXCEPTION. This chapter does not apply to:
8181 (1) a health benefit plan that provides coverage:
8282 (A) only for a specified disease or for another
8383 limited benefit;
8484 (B) only for accidental death or dismemberment;
8585 (C) for wages or payments in lieu of wages for a
8686 period during which an employee is absent from work because of
8787 sickness or injury;
8888 (D) as a supplement to a liability insurance
8989 policy; or
9090 (E) only for indemnity for hospital confinement;
9191 (2) [a small employer health benefit plan written
9292 under Chapter 1501;
9393 [(3)] a Medicare supplemental policy as defined by
9494 Section 1882(g)(1), Social Security Act (42 U.S.C. Section 1395ss);
9595 (3) [(4)] a workers' compensation insurance policy;
9696 (4) [(5)] medical payment insurance coverage provided
9797 under a motor vehicle insurance policy; or
9898 (5) [(6)] a long-term care insurance policy,
9999 including a nursing home fixed indemnity policy, unless the
100100 commissioner determines that the policy provides benefit coverage
101101 so comprehensive that the policy is a health benefit plan as
102102 described by Section 1362.001.
103103 SECTION 3. Section 1362.003, Insurance Code, is amended by
104104 adding Subsection (c) to read as follows:
105105 (c) A health benefit plan that provides coverage under this
106106 section may not charge any premium, copayment, coinsurance,
107107 deductible, or any other form of cost sharing for a covered benefit
108108 described by this section.
109109 SECTION 4. Section 1575.159, Insurance Code, is repealed.
110110 SECTION 5. If before implementing any provision of this Act
111111 a state agency determines that a waiver or authorization from a
112112 federal agency is necessary for implementation of that provision,
113113 the agency affected by the provision shall request the waiver or
114114 authorization and may delay implementing that provision until the
115115 waiver or authorization is granted.
116116 SECTION 6. The changes in law made by this Act apply only to
117117 a health benefit plan delivered, issued for delivery, or renewed on
118118 or after January 1, 2024. A health benefit plan delivered, issued
119119 for delivery, or renewed before January 1, 2024, is governed by the
120120 law as it existed immediately before the effective date of this Act,
121121 and that law is continued in effect for that purpose.
122122 SECTION 7. This Act takes effect September 1, 2023.
