| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 202, Property Code, is amended by adding |
|---|
| 10 | 10 | | Section 202.024 to read as follows: |
|---|
| 11 | 11 | | Sec. 202.024. DISCRIMINATION AGAINST TENANT BASED ON METHOD |
|---|
| 12 | 12 | | OF PAYMENT PROHIBITED. (a) In this section, "method of payment" |
|---|
| 13 | 13 | | includes payment made in whole or in part by: |
|---|
| 14 | 14 | | (1) a housing choice voucher under Section 8, United |
|---|
| 15 | 15 | | States Housing Act of 1937 (42 U.S.C. Section 1437f); or |
|---|
| 16 | 16 | | (2) any other federal or state or local housing |
|---|
| 17 | 17 | | assistance provided to a person or to a property owner on behalf of |
|---|
| 18 | 18 | | a person, including rental vouchers, rental assistance, or rental |
|---|
| 19 | 19 | | subsidies from a nongovernmental organization. |
|---|
| 20 | 20 | | (b) A property owners' association may not include or |
|---|
| 21 | 21 | | enforce a provision in a dedicatory instrument that prohibits or |
|---|
| 22 | 22 | | restricts a property owner from renting a dwelling to a person based |
|---|
| 23 | 23 | | on the person's method of payment. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
