| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 75, Parks and Wildlife Code, is amended |
|---|
| 11 | 11 | | by adding Section 75.01055 to read as follows: |
|---|
| 12 | 12 | | Sec. 75.01055. CLEANING OF STRUCTURES USED FOR GROWING |
|---|
| 13 | 13 | | OYSTERS. A cultivated oyster mariculture permit holder may clean a |
|---|
| 14 | 14 | | structure used to grow oysters for cultivated oyster mariculture at |
|---|
| 15 | 15 | | the location where the permit holder is authorized to operate if the |
|---|
| 16 | 16 | | permit holder: |
|---|
| 17 | 17 | | (1) cleans the structure only with water from the |
|---|
| 18 | 18 | | location where the permit holder is authorized to operate; and |
|---|
| 19 | 19 | | (2) does not use soap, chemicals, or any other similar |
|---|
| 20 | 20 | | substance to clean the structure. |
|---|
| 21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
