5	5	relating to prescription drug formularies applicable to the
6	6	Medicaid managed care program.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 533.005(a-1), Government Code, is
9	9	amended to read as follows:
10	10	(a-1) The requirements imposed by Subsections (a)(23)(A),
11	11	(B), and (C) do not apply, and may not be enforced, on and after
12	12	August 31, 2033 [2023].
13	13	SECTION 2. If before implementing any provision of this Act
14	14	a state agency determines that a waiver or authorization from a
15	15	federal agency is necessary for implementation of that provision,
16	16	the agency affected by the provision shall request the waiver or
17	17	authorization and may delay implementing that provision until the
18	18	waiver or authorization is granted.
19	19	SECTION 3. This Act takes effect September 1, 2023.
