44 AN ACT
55 relating to prescription drug formularies applicable to the
66 Medicaid managed care program.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 533.005(a-1), Government Code, is
99 amended to read as follows:
1010 (a-1) The requirements imposed by Subsections (a)(23)(A),
1111 (B), and (C) do not apply, and may not be enforced, on and after
1212 August 31, 2033 [2023].
1313 SECTION 2. If before implementing any provision of this Act
1414 a state agency determines that a waiver or authorization from a
1515 federal agency is necessary for implementation of that provision,
1616 the agency affected by the provision shall request the waiver or
1717 authorization and may delay implementing that provision until the
1818 waiver or authorization is granted.
1919 SECTION 3. This Act takes effect September 1, 2023.
