| 5 | 5 | | relating to the public hearing requirement for a preliminary zoning |

| 6 | 6 | | report made by a zoning commission. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 211.007(b), Local Government Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (b) The zoning commission shall make a preliminary report |
|---|
| 11 | 11 | | and hold at least one public hearing [hearings] on that report |
|---|
| 12 | 12 | | before submitting a final report to the governing body. The |
|---|
| 13 | 13 | | governing body may not hold a public hearing until it receives the |
|---|
| 14 | 14 | | final report of the zoning commission unless the governing body by |
|---|
| 15 | 15 | | ordinance provides that a public hearing is to be held, after the |
|---|
| 16 | 16 | | notice required by Section 211.006(a), jointly with a public |
|---|
| 17 | 17 | | hearing required to be held by the zoning commission. In either |
|---|
| 18 | 18 | | case, the governing body may not take action on the matter until it |
|---|
| 19 | 19 | | receives the final report of the zoning commission. |
|---|
| 20 | 20 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 21 | 21 | | to a proposal to change a municipal zoning classification made on or |
|---|
| 22 | 22 | | after the effective date of this Act. A proposal to change a |
|---|
| 23 | 23 | | municipal zoning classification made before the effective date of |
|---|
| 24 | 24 | | this Act is governed by the law in effect on the date the proposal |
|---|
| 25 | 25 | | was made, and the former law is continued in effect for that |
|---|
| 26 | 26 | | purpose. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2023. |
