55 relating to the public hearing requirement for a preliminary zoning

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 211.007(b), Local Government Code, is
99 amended to read as follows:
1010 (b) The zoning commission shall make a preliminary report
1111 and hold at least one public hearing [hearings] on that report
1212 before submitting a final report to the governing body. The
1313 governing body may not hold a public hearing until it receives the
1414 final report of the zoning commission unless the governing body by
1515 ordinance provides that a public hearing is to be held, after the
1616 notice required by Section 211.006(a), jointly with a public
1717 hearing required to be held by the zoning commission. In either
1818 case, the governing body may not take action on the matter until it
1919 receives the final report of the zoning commission.
2020 SECTION 2. The change in law made by this Act applies only
2121 to a proposal to change a municipal zoning classification made on or
2222 after the effective date of this Act. A proposal to change a
2323 municipal zoning classification made before the effective date of
2424 this Act is governed by the law in effect on the date the proposal
2525 was made, and the former law is continued in effect for that
2626 purpose.
2727 SECTION 3. This Act takes effect September 1, 2023.
