| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter F, Chapter 203, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 203.113 to read as follows: |
|---|
| 13 | 13 | | Sec. 203.113. INSTALLATION AND OPERATION OF CERTAIN |
|---|
| 14 | 14 | | ELECTRIC VEHICLE CHARGING STATIONS. The department shall ensure |
|---|
| 15 | 15 | | that an electric vehicle charging station installed or funded by |
|---|
| 16 | 16 | | the department: |
|---|
| 17 | 17 | | (1) is capable of sending and receiving information |
|---|
| 18 | 18 | | through a communications network; |
|---|
| 19 | 19 | | (2) is capable of responding to a signal from the |
|---|
| 20 | 20 | | electric grid by: |
|---|
| 21 | 21 | | (A) starting or stopping a charge; or |
|---|
| 22 | 22 | | (B) increasing or decreasing the rate of |
|---|
| 23 | 23 | | electricity flow; and |
|---|
| 24 | 24 | | (3) has at least one user interface that allows a user |
|---|
| 25 | 25 | | to operate the charging station in accordance with Subdivisions (1) |
|---|
| 26 | 26 | | and (2). |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
