66 relating to axle weight limitations for certain vehicles

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 621.101, Transportation Code, is amended
1010 by adding Subsection (b-2) to read as follows:
1111 (b-2) Notwithstanding Subsections (a)(1) and (2), a vehicle
1212 or combination of vehicles that is transporting aggregates, as
1313 defined by Section 28A.001, Water Code, over a highway or road of
1414 this state may operate at an axle weight that is not heavier than
1515 the weight equal to the maximum allowable axle weight provided by
1616 those subdivisions plus a tolerance allowance of 15 percent of that
1717 allowable weight, provided that the gross weight of the vehicle or
1818 combination of vehicles is not heavier than the maximum gross
1919 weight authorized for the roadway on which the vehicle or
2020 combination of vehicles is being operated.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2023.
