| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 8 | | SECTION 1. Section 2306.753(b), Government Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | (b) To be eligible for a loan under this subchapter, an |
|---|
| 11 | 11 | | owner-builder: |
|---|
| 12 | 12 | | (1) may not have an annual income that exceeds 80 [60] |
|---|
| 13 | 13 | | percent, as determined by the department, of the greater of the |
|---|
| 14 | 14 | | state or local median family income, when combined with the income |
|---|
| 15 | 15 | | of any person who resides with the owner-builder; |
|---|
| 16 | 16 | | (2) must have resided in this state for the preceding |
|---|
| 17 | 17 | | six months; |
|---|
| 18 | 18 | | (3) must have successfully completed an owner-builder |
|---|
| 19 | 19 | | education class under Section 2306.756; and |
|---|
| 20 | 20 | | (4) must agree to: |
|---|
| 21 | 21 | | (A) provide through personal labor at least 65 |
|---|
| 22 | 22 | | percent of the labor necessary to build or rehabilitate the |
|---|
| 23 | 23 | | proposed housing by working through a state-certified |
|---|
| 24 | 24 | | owner-builder housing program; |
|---|
| 25 | 25 | | (B) provide an amount of personal labor |
|---|
| 26 | 26 | | equivalent to the amount required under Paragraph (A) in connection |
|---|
| 27 | 27 | | with building or rehabilitating housing for others through a |
|---|
| 28 | 28 | | state-certified owner-builder housing program; |
|---|
| 29 | 29 | | (C) provide through the noncontract labor of |
|---|
| 30 | 30 | | friends, family, or volunteers and through personal labor at least |
|---|
| 31 | 31 | | 65 percent of the labor necessary to build or rehabilitate the |
|---|
| 32 | 32 | | proposed housing by working through a state-certified |
|---|
| 33 | 33 | | owner-builder housing program; or |
|---|
| 34 | 34 | | (D) if due to documented disability or other |
|---|
| 35 | 35 | | limiting circumstances as defined by department rule the |
|---|
| 36 | 36 | | owner-builder cannot provide the amount of personal labor otherwise |
|---|
| 37 | 37 | | required by this subdivision, provide through the noncontract labor |
|---|
| 38 | 38 | | of friends, family, or volunteers at least 65 percent of the labor |
|---|
| 39 | 39 | | necessary to build or rehabilitate the proposed housing by working |
|---|
| 40 | 40 | | through a state-certified owner-builder housing program. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2023. |
