| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 75.002, Civil Practice and Remedies |

| 11 | 11 | | Code, is amended by adding Subsection (f-1) to read as follows: |

| 12 | 12 | | (f-1) An irrigation district is not liable for injury to an |
|---|
| 13 | 13 | | individual or property arising from the recreational use of the |
|---|
| 14 | 14 | | district's land unless the injury arises from an act or omission of |
|---|
| 15 | 15 | | the district that constitutes recklessness or intentional |
|---|
| 16 | 16 | | misconduct. |

| 17 | 17 | | SECTION 2. Section 75.002(f-1), Civil Practice and Remedies |
|---|
| 18 | 18 | | Code, as added by this Act, applies only to a cause of action that |
|---|
| 19 | 19 | | accrues on or after the effective date of this Act. |
|---|
| 20 | 20 | | SECTION 3. This Act takes effect September 1, 2023. |
