A BILL TO BE ENTITLED
AN ACT
relating to civil liability of irrigation districts for the
recreational use of district land.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 75.002, Civil Practice and Remedies
Code, is amended by adding Subsection (f-1) to read as follows:
(f-1) An irrigation district is not liable for injury to an
individual or property arising from the recreational use of the
district's land unless the injury arises from an act or omission of
the district that constitutes recklessness or intentional
misconduct.
SECTION 2. Section 75.002(f-1), Civil Practice and Remedies
Code, as added by this Act, applies only to a cause of action that
accrues on or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2023.
