| 7 | 7 | | Visiting Program services and to the delivery of those services. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 531.982, Government Code, is amended by |
|---|
| 10 | 10 | | adding Subsections (d), (e), and (f) to read as follows: |
|---|
| 11 | 11 | | (d) A minor who is otherwise eligible for a home visiting |
|---|
| 12 | 12 | | program may consent to enrollment in and to receive services from a |
|---|
| 13 | 13 | | home visiting program. For purposes of this subsection, "minor" |
|---|
| 14 | 14 | | means an individual who is younger than 18 years of age. |
|---|
| 15 | 15 | | (e) A health professional or other person providing |
|---|
| 16 | 16 | | services under the home visiting program must obtain the express |
|---|
| 17 | 17 | | consent of the owner or adult occupant of the residence or property |
|---|
| 18 | 18 | | before the person may enter the residence or property to provide |
|---|
| 19 | 19 | | services under the program. |
|---|
| 20 | 20 | | (f) Subsection (d) does not authorize a health professional |
|---|
| 21 | 21 | | or other person providing services under the home visiting program |
|---|
| 22 | 22 | | to enter or remain in the residence or on the property of another in |
|---|
| 23 | 23 | | violation of Section 30.05, Penal Code. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
