5	5	relating to the workforce development evaluation system
6	6	administered by the Texas Workforce Commission, including the
7	7	establishment of a workforce development career education and
8	8	training evaluation pilot program.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 302.001, Labor Code, is amended by
11	11	amending Subdivision (1) and adding Subdivision (1-a) to read as
12	12	follows:
13	13	(1) "Career education and training program" has the
14	14	meaning assigned by Section 2308A.001, Government Code.
15	15	(1-a) "Director" means the director of the division.
16	16	SECTION 2. Subchapter A, Chapter 302, Labor Code, is
17	17	amended by adding Section 302.0201 to read as follows:
18	18	Sec. 302.0201. WORKFORCE DEVELOPMENT CAREER EDUCATION AND
19	19	TRAINING EVALUATION PILOT PROGRAM. (a) The commission shall
20	20	establish and administer a pilot program in the Borderplex
21	21	workforce development area under which the local workforce
22	22	development board serving that area is required to collect and
23	23	evaluate cross-sectional data and longitudinal supplemental data
24	24	regarding career education and training programs administered in
25	25	that area for the purposes of identifying:
26	26	(1) successful program components; and
27	27	(2) any gaps in data used to follow up on career
28	28	education and training program participants following program
29	29	completion maintained by the commission, the Texas Education
30	30	Agency, or the Texas Higher Education Coordinating Board under the
31	31	Tri-Agency Workforce Initiative established under Chapter 2308A,
32	32	Government Code.
33	33	(b) Under the pilot program, the commission shall ensure
34	34	that the local workforce development board serving the workforce
35	35	development area maintains the following information for each
36	36	career education and training program participant following
37	37	program completion, disaggregated by race, ethnicity, sex, income,
38	38	and location:
39	39	(1) the evaluation data described by Section
40	40	302.082(b); and
41	41	(2) data regarding the attainment of employment paying
42	42	a self-sufficient wage, as determined under Section 2308A.012,
43	43	Government Code.
44	44	(c) On completion of the pilot program, the local workforce
45	45	development board serving the workforce development area, in
46	46	coordination with the commission, shall issue an analysis, by
47	47	occupation and by provider, of the job placement performance of
48	48	each career education and training program. The analysis must
49	49	include:
50	50	(1) an analysis of the attainment of employment paying
51	51	a self-sufficient wage, as determined under Section 2308A.012,
52	52	Government Code, following program completion; and
53	53	(2) detailed information on the services provided with
54	54	each offered program.
55	55	(d) The commission may share individual-level outcome
56	56	information resulting from the pilot program with state agencies
57	57	represented on the council through secure means that may be
58	58	accessed only by authorized employees of those agencies.
59	59	(e) Not later than December 1, 2028, the commission shall
60	60	submit to the legislature a written report on the results of the
61	61	pilot program. The report must include the commission's
62	62	recommendation on whether the pilot program should be continued on
63	63	a statewide basis.
64	64	(f) This section expires September 1, 2029.
65	65	SECTION 3. Section 302.082, Labor Code, is amended by
66	66	amending Subsections (b) and (c) and adding Subsection (d) to read
67	67	as follows:
68	68	(b) Evaluation data in the system must include the following
69	69	information disaggregated by race, ethnicity, sex, income, and
70	70	location:
71	71	(1) placement rates;
72	72	(2) wages paid;
73	73	(3) retention in employment statistics;
74	74	(4) the number of education and training-related
75	75	placements; and
76	76	(5) other appropriate factors, including public
77	77	welfare dependency and the pursuit of additional education.
78	78	(c) The commission may develop a method for collecting
79	79	occupational information to supplement wage record information
80	80	collected by the commission under Section 204.0025. The commission
81	81	may request employers, providers, and other appropriate sources to
82	82	provide placement, employment, and earnings information to the
83	83	commission.
84	84	(d) The commission shall ensure that:
85	85	(1) the system includes with the evaluation data a
86	86	hyperlink to an Internet website where self-sufficient wage data as
87	87	determined under Section 2308A.012, Government Code, is posted; and
88	88	(2) following any modernization of the evaluation
89	89	system by the commission on or after September 1, 2023, the
90	90	evaluation data in the system includes a comparison of
91	91	self-sufficient wage data with program earnings outcomes at the
92	92	first, third, and fifth anniversary of the date of program
93	93	completion.
94	94	SECTION 4. Section 302.083, Labor Code, is amended by
95	95	adding Subsection (a-1) to read as follows:
96	96	(a-1) Following any modernization of the evaluation system
97	97	by the commission on or after September 1, 2023, an analysis issued
98	98	under Subsection (a) must include:
99	99	(1) an analysis regarding the attainment of employment
100	100	paying a self-sufficient wage, as determined under Section
101	101	2308A.012, Government Code, following completion of a career
102	102	education and training program; and
103	103	(2) detailed information on the services provided with
104	104	each offered program.
105	105	SECTION 5. This Act takes effect September 1, 2023.
