55 relating to the workforce development evaluation system
66 administered by the Texas Workforce Commission, including the
77 establishment of a workforce development career education and
88 training evaluation pilot program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 302.001, Labor Code, is amended by
1111 amending Subdivision (1) and adding Subdivision (1-a) to read as
1212 follows:
1313 (1) "Career education and training program" has the
1414 meaning assigned by Section 2308A.001, Government Code.
1515 (1-a) "Director" means the director of the division.
1616 SECTION 2. Subchapter A, Chapter 302, Labor Code, is
1717 amended by adding Section 302.0201 to read as follows:
1818 Sec. 302.0201. WORKFORCE DEVELOPMENT CAREER EDUCATION AND
1919 TRAINING EVALUATION PILOT PROGRAM. (a) The commission shall
2020 establish and administer a pilot program in the Borderplex
2121 workforce development area under which the local workforce
2222 development board serving that area is required to collect and
2323 evaluate cross-sectional data and longitudinal supplemental data
2424 regarding career education and training programs administered in
2525 that area for the purposes of identifying:
2626 (1) successful program components; and
2727 (2) any gaps in data used to follow up on career
2828 education and training program participants following program
2929 completion maintained by the commission, the Texas Education
3030 Agency, or the Texas Higher Education Coordinating Board under the
3131 Tri-Agency Workforce Initiative established under Chapter 2308A,
3232 Government Code.
3333 (b) Under the pilot program, the commission shall ensure
3434 that the local workforce development board serving the workforce
3535 development area maintains the following information for each
3636 career education and training program participant following
3737 program completion, disaggregated by race, ethnicity, sex, income,
3838 and location:
3939 (1) the evaluation data described by Section
4040 302.082(b); and
4141 (2) data regarding the attainment of employment paying
4242 a self-sufficient wage, as determined under Section 2308A.012,
4343 Government Code.
4444 (c) On completion of the pilot program, the local workforce
4545 development board serving the workforce development area, in
4646 coordination with the commission, shall issue an analysis, by
4747 occupation and by provider, of the job placement performance of
4848 each career education and training program. The analysis must
4949 include:
5050 (1) an analysis of the attainment of employment paying
5151 a self-sufficient wage, as determined under Section 2308A.012,
5252 Government Code, following program completion; and
5353 (2) detailed information on the services provided with
5454 each offered program.
5555 (d) The commission may share individual-level outcome
5656 information resulting from the pilot program with state agencies
5757 represented on the council through secure means that may be
5858 accessed only by authorized employees of those agencies.
5959 (e) Not later than December 1, 2028, the commission shall
6060 submit to the legislature a written report on the results of the
6161 pilot program. The report must include the commission's
6262 recommendation on whether the pilot program should be continued on
6363 a statewide basis.
6464 (f) This section expires September 1, 2029.
6565 SECTION 3. Section 302.082, Labor Code, is amended by
6666 amending Subsections (b) and (c) and adding Subsection (d) to read
6767 as follows:
6868 (b) Evaluation data in the system must include the following
6969 information disaggregated by race, ethnicity, sex, income, and
7070 location:
7171 (1) placement rates;
7272 (2) wages paid;
7373 (3) retention in employment statistics;
7474 (4) the number of education and training-related
7575 placements; and
7676 (5) other appropriate factors, including public
7777 welfare dependency and the pursuit of additional education.
7878 (c) The commission may develop a method for collecting
7979 occupational information to supplement wage record information
8080 collected by the commission under Section 204.0025. The commission
8181 may request employers, providers, and other appropriate sources to
8282 provide placement, employment, and earnings information to the
8383 commission.
8484 (d) The commission shall ensure that:
8585 (1) the system includes with the evaluation data a
8686 hyperlink to an Internet website where self-sufficient wage data as
8787 determined under Section 2308A.012, Government Code, is posted; and
8888 (2) following any modernization of the evaluation
8989 system by the commission on or after September 1, 2023, the
9090 evaluation data in the system includes a comparison of
9191 self-sufficient wage data with program earnings outcomes at the
9292 first, third, and fifth anniversary of the date of program
9393 completion.
9494 SECTION 4. Section 302.083, Labor Code, is amended by
9595 adding Subsection (a-1) to read as follows:
9696 (a-1) Following any modernization of the evaluation system
9797 by the commission on or after September 1, 2023, an analysis issued
9898 under Subsection (a) must include:
9999 (1) an analysis regarding the attainment of employment
100100 paying a self-sufficient wage, as determined under Section
101101 2308A.012, Government Code, following completion of a career
102102 education and training program; and
103103 (2) detailed information on the services provided with
104104 each offered program.
105105 SECTION 5. This Act takes effect September 1, 2023.
