77 AN ACT
88 relating to the medical use of low-THC cannabis by patients with
99 certain medical conditions.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 169.001(3), Occupations Code, is amended
1212 to read as follows:
1313 (3) "Low-THC cannabis" means the plant Cannabis sativa
1414 L., and any part of that plant or any compound, manufacture, salt,
1515 derivative, mixture, preparation, resin, or oil of that plant that
1616 contains not more than 10 milligrams [one percent by weight] of
1717 tetrahydrocannabinols in each dosage unit.
1818 SECTION 2. Section 169.003, Occupations Code, is amended to
1919 read as follows:
2020 Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. (a) A
2121 physician described by Section 169.002 may prescribe low-THC
2222 cannabis to a patient if:
2323 (1) the patient is a permanent resident of the state;
2424 (2) the physician complies with the registration
2525 requirements of Section 169.004; and
2626 (3) the physician certifies to the department that:
2727 (A) the patient is diagnosed with:
2828 (i) epilepsy;
2929 (ii) a seizure disorder;
3030 (iii) multiple sclerosis;
3131 (iv) spasticity;
3232 (v) amyotrophic lateral sclerosis;
3333 (vi) autism;
3434 (vii) cancer;
3535 (viii) an incurable neurodegenerative
3636 disease;
3737 (ix) post-traumatic stress disorder; [or]
3838 (x) a condition that causes chronic pain,
3939 for which a physician would otherwise prescribe an opioid;
4040 (xi) a medical condition that is approved
4141 for a research program under Subchapter F, Chapter 487, Health and
4242 Safety Code, and for which the patient is receiving treatment under
4343 that program; or
4444 (xii) a debilitating medical condition
4545 designated by the Department of State Health Services under
4646 Subsection (b); and
4747 (B) the physician determines the risk of the
4848 medical use of low-THC cannabis by the patient is reasonable in
4949 light of the potential benefit for the patient.
5050 (b) The Department of State Health Services by rule may
5151 designate debilitating medical conditions for which a physician may
5252 prescribe low-THC cannabis under this section.
5353 SECTION 3. This Act takes effect September 1, 2023.
