| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 320.0455(a) and (b-1), Local Government |
|---|
| 11 | 11 | | Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) This section applies only to a county with a population |
|---|
| 13 | 13 | | of: |
|---|
| 14 | 14 | | (1) 2.8 million or more; |
|---|
| 15 | 15 | | (2) 580,000 or more that is adjacent to a county with a |
|---|
| 16 | 16 | | population of 2.8 million or more; [or] |
|---|
| 17 | 17 | | (3) more than 410,000 and less than 455,000; or |
|---|
| 18 | 18 | | (4) less than 75,000 that is adjacent to three |
|---|
| 19 | 19 | | counties with populations of more than 450,000. |
|---|
| 20 | 20 | | (b-1) A board created for a county described by Subsection |
|---|
| 21 | 21 | | (a)(2) or (a)(4) may not adopt rules relating to the use of |
|---|
| 22 | 22 | | fireworks. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
