55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the dissolution by petition of a municipal management
88 district; making conforming changes related to ship channel
99 security districts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 375.262, Local Government Code, is
1212 amended to read as follows:
1313 Sec. 375.262. DISSOLUTION BY PETITION BY OWNERS. (a)
1414 Except as limited by Section 375.264, the board shall dissolve the
1515 district on written petition filed with the board by the owners of
1616 the majority [at least two-thirds] of the assessed value of the
1717 property subject to assessment or taxation by the district based on
1818 the most recent certified county property tax rolls.
1919 (b) In all areas of conflict the provisions of this section
2020 take precedence over a special law governing a district.
2121 SECTION 2. Section 68.352(b), Water Code, is amended to
2222 read as follows:
2323 (b) A district may be dissolved as provided by Section
2424 375.262, Local Government Code, except that the written petition
2525 must be filed by the owners of at least two-thirds of the assessed
2626 value of the property subject to assessment or taxation by the
2727 district based on the most recent certified county property tax
2828 rolls.
2929 SECTION 3. The changes in law made by this Act apply only to
3030 a petition described by Section 375.262, Local Government Code,
3131 filed on or after the effective date of this Act. A petition filed
3232 before the effective date of this Act is governed by the law in
3333 effect on the date the petition was filed, and the former law is
3434 continued in effect for that purpose.
3535 SECTION 4. This Act takes effect September 1, 2023.
