| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 493, Government Code, is amended by |
|---|
| 12 | 12 | | adding Section 493.035 to read as follows: |
|---|
| 13 | 13 | | Sec. 493.035. PAYMENT FOR VACATION LEAVE. (a) The |
|---|
| 14 | 14 | | department may adopt a policy allowing department employees, one |
|---|
| 15 | 15 | | time during a fiscal year, to elect to receive a lump-sum payment |
|---|
| 16 | 16 | | for the employee's accumulated vacation leave in lieu of taking the |
|---|
| 17 | 17 | | leave. |
|---|
| 18 | 18 | | (b) The number of hours of accumulated vacation leave for |
|---|
| 19 | 19 | | which an employee may be paid under a policy authorized by this |
|---|
| 20 | 20 | | section may not exceed all of the employee's accumulated vacation |
|---|
| 21 | 21 | | leave or 40 hours of accumulated vacation leave, whichever is less. |
|---|
| 22 | 22 | | (c) If the department pays a department employee for the |
|---|
| 23 | 23 | | employee's accumulated vacation leave under a policy authorized by |
|---|
| 24 | 24 | | this section, the department shall: |
|---|
| 25 | 25 | | (1) compute the amount of the payment by multiplying |
|---|
| 26 | 26 | | the employee's hourly rate of compensation on the date the employee |
|---|
| 27 | 27 | | notifies the department of an election by the number of hours of |
|---|
| 28 | 28 | | accumulated vacation leave for which the employee elects to be |
|---|
| 29 | 29 | | paid; and |
|---|
| 30 | 30 | | (2) on making the payment, deduct the number of hours |
|---|
| 31 | 31 | | for which the employee received payment from the employee's |
|---|
| 32 | 32 | | accumulated vacation leave balance. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
