77 AN ACT
88 relating to authorizing the payment to employees of the Texas
99 Department of Criminal Justice for vacation leave.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 493, Government Code, is amended by
1212 adding Section 493.035 to read as follows:
1313 Sec. 493.035. PAYMENT FOR VACATION LEAVE. (a) The
1414 department may adopt a policy allowing department employees, one
1515 time during a fiscal year, to elect to receive a lump-sum payment
1616 for the employee's accumulated vacation leave in lieu of taking the
1717 leave.
1818 (b) The number of hours of accumulated vacation leave for
1919 which an employee may be paid under a policy authorized by this
2020 section may not exceed all of the employee's accumulated vacation
2121 leave or 40 hours of accumulated vacation leave, whichever is less.
2222 (c) If the department pays a department employee for the
2323 employee's accumulated vacation leave under a policy authorized by
2424 this section, the department shall:
2525 (1) compute the amount of the payment by multiplying
2626 the employee's hourly rate of compensation on the date the employee
2727 notifies the department of an election by the number of hours of
2828 accumulated vacation leave for which the employee elects to be
2929 paid; and
3030 (2) on making the payment, deduct the number of hours
3131 for which the employee received payment from the employee's
3232 accumulated vacation leave balance.
3333 SECTION 2. This Act takes effect September 1, 2023.
