| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 36, Water Code, is amended |
|---|
| 11 | 11 | | by adding Section 36.022 to read as follows: |
|---|
| 12 | 12 | | Sec. 36.022. COMMISSION MAY NOT CREATE DISTRICT. |
|---|
| 13 | 13 | | Notwithstanding any other law, the commission may not issue an |
|---|
| 14 | 14 | | order creating a district after September 1, 2023. |
|---|
| 15 | 15 | | SECTION 2. Subchapter B, Chapter 49, Water Code, is amended |
|---|
| 16 | 16 | | by adding Section 49.012 to read as follows: |
|---|
| 17 | 17 | | Sec. 49.012. COMMISSION MAY NOT CREATE DISTRICT. |
|---|
| 18 | 18 | | Notwithstanding any other law, the commission may not issue an |
|---|
| 19 | 19 | | order creating a district after September 1, 2023. |
|---|
| 20 | 20 | | SECTION 3. Subchapter B, Chapter 375, Local Government |
|---|
| 21 | 21 | | Code, is amended by adding Section 375.027 to read as follows: |

| 22 | 22 | | Sec. 375.027. COMMISSION MAY NOT CREATE DISTRICT. |

| 23 | 23 | | Notwithstanding any other law, the commission may not issue an |
|---|
| 24 | 24 | | order creating a district after September 1, 2023. |

| 25 | 25 | | SECTION 4. The changes in law made by this Act do not apply |
|---|
| 26 | 26 | | to the creation of a district for which the required documentation |
|---|
| 27 | 27 | | or petition was submitted to the Texas Commission on Environmental |
|---|
| 28 | 28 | | Quality before the effective date of this Act. The creation of a |
|---|
| 29 | 29 | | district for which the required documentation or petition was |
|---|
| 30 | 30 | | submitted to the Texas Commission on Environmental Quality before |
|---|
| 31 | 31 | | the effective date of this Act is governed by the law in effect on |
|---|
| 32 | 32 | | the date the district submitted the documentation or petition, and |
|---|
| 33 | 33 | | the former law is continued in effect for that purpose. |
|---|
| 34 | 34 | | SECTION 5. This Act takes effect September 1, 2023. |
