A BILL TO BE ENTITLED
AN ACT
relating to the authority of the Texas Commission on Environmental
Quality to issue an order to create a special district.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 36, Water Code, is amended
by adding Section 36.022 to read as follows:
Sec. 36.022. COMMISSION MAY NOT CREATE DISTRICT.
Notwithstanding any other law, the commission may not issue an
order creating a district after September 1, 2023.
SECTION 2. Subchapter B, Chapter 49, Water Code, is amended
by adding Section 49.012 to read as follows:
Sec. 49.012. COMMISSION MAY NOT CREATE DISTRICT.
Notwithstanding any other law, the commission may not issue an
order creating a district after September 1, 2023.
SECTION 3. Subchapter B, Chapter 375, Local Government
Code, is amended by adding Section 375.027 to read as follows:
Sec. 375.027. COMMISSION MAY NOT CREATE DISTRICT.
Notwithstanding any other law, the commission may not issue an
order creating a district after September 1, 2023.
SECTION 4. The changes in law made by this Act do not apply
to the creation of a district for which the required documentation
or petition was submitted to the Texas Commission on Environmental
Quality before the effective date of this Act. The creation of a
district for which the required documentation or petition was
submitted to the Texas Commission on Environmental Quality before
the effective date of this Act is governed by the law in effect on
the date the district submitted the documentation or petition, and
the former law is continued in effect for that purpose.
SECTION 5. This Act takes effect September 1, 2023.
