55 relating to the confidentiality of certain home address information
66 in ad valorem tax appraisal records.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 25.025(a), Tax Code, is amended to read
99 as follows:
1010 (a) This section applies only to:
1111 (1) a current or former peace officer as defined by
1212 Article 2.12, Code of Criminal Procedure, and the spouse or
1313 surviving spouse of the peace officer;
1414 (2) the adult child of a current peace officer as
1515 defined by Article 2.12, Code of Criminal Procedure;
1616 (3) a current or honorably retired county jailer as
1717 defined by Section 1701.001, Occupations Code;
1818 (4) an employee of the Texas Department of Criminal
1919 Justice;
2020 (5) a commissioned security officer as defined by
2121 Section 1702.002, Occupations Code;
2222 (6) an individual who shows that the individual, the
2323 individual's child, or another person in the individual's household
2424 is a victim of family violence as defined by Section 71.004, Family
2525 Code, by providing:
2626 (A) a copy of a protective order issued under
2727 Chapter 85, Family Code, or a magistrate's order for emergency
2828 protection issued under Article 17.292, Code of Criminal Procedure;
2929 or
3030 (B) other independent documentary evidence
3131 necessary to show that the individual, the individual's child, or
3232 another person in the individual's household is a victim of family
3333 violence;
3434 (7) an individual who shows that the individual, the
3535 individual's child, or another person in the individual's household
3636 is a victim of sexual assault or abuse, stalking, or trafficking of
3737 persons by providing:
3838 (A) a copy of a protective order issued under
3939 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
4040 magistrate's order for emergency protection issued under Article
4141 17.292, Code of Criminal Procedure; or
4242 (B) other independent documentary evidence
4343 necessary to show that the individual, the individual's child, or
4444 another person in the individual's household is a victim of sexual
4545 assault or abuse, stalking, or trafficking of persons;
4646 (8) a participant in the address confidentiality
4747 program administered by the attorney general under Subchapter B,
4848 Chapter 58, Code of Criminal Procedure, who provides proof of
4949 certification under Article 58.059, Code of Criminal Procedure;
5050 (9) a federal judge, a federal bankruptcy judge, a
5151 marshal of the United States Marshals Service, a state judge, or a
5252 family member of a federal judge, a federal bankruptcy judge, a
5353 marshal of the United States Marshals Service, or a state judge;
5454 (10) a current or former district attorney, criminal
5555 district attorney, or county or municipal attorney whose
5656 jurisdiction includes any criminal law or child protective services
5757 matters;
5858 (11) a current or former employee of a district
5959 attorney, criminal district attorney, or county or municipal
6060 attorney whose jurisdiction includes any criminal law or child
6161 protective services matters;
6262 (12) an officer or employee of a community supervision
6363 and corrections department established under Chapter 76,
6464 Government Code, who performs a duty described by Section 76.004(b)
6565 of that code;
6666 (13) a criminal investigator of the United States as
6767 described by Article 2.122(a), Code of Criminal Procedure;
6868 (14) a current or honorably retired police officer or
6969 inspector of the United States Federal Protective Service;
7070 (15) a current or former United States attorney,
7171 assistant United States attorney, federal public defender, deputy
7272 federal public defender, or assistant federal public defender and
7373 the spouse and child of the attorney or public defender;
7474 (16) a current or former employee of the office of the
7575 attorney general who is or was assigned to a division of that office
7676 the duties of which involve law enforcement;
7777 (17) a medical examiner or person who performs
7878 forensic analysis or testing who is employed by this state or one or
7979 more political subdivisions of this state;
8080 (18) a current or former member of the United States
8181 armed forces who has served in an area that the president of the
8282 United States by executive order designates for purposes of 26
8383 U.S.C. Section 112 as an area in which armed forces of the United
8484 States are or have engaged in combat;
8585 (19) a current or former employee of the Texas
8686 Juvenile Justice Department or of the predecessors in function of
8787 the department;
8888 (20) a current or former juvenile probation or
8989 supervision officer certified by the Texas Juvenile Justice
9090 Department, or the predecessors in function of the department,
9191 under Title 12, Human Resources Code;
9292 (21) a current or former employee of a juvenile
9393 justice program or facility, as those terms are defined by Section
9494 261.405, Family Code;
9595 (22) a current or former employee of the Texas Civil
9696 Commitment Office or the predecessor in function of the office or a
9797 division of the office;
9898 (23) a current or former employee of a federal judge or
9999 state judge;
100100 (24) a current or former child protective services
101101 caseworker, adult protective services caseworker, or investigator
102102 for the Department of Family and Protective Services or a current or
103103 former employee of a department contractor performing child
104104 protective services caseworker, adult protective services
105105 caseworker, or investigator functions for the contractor on behalf
106106 of the department;
107107 (25) an elected public officer; [and]
108108 (26) a firefighter or volunteer firefighter or
109109 emergency medical services personnel as defined by Section 773.003,
110110 Health and Safety Code;
111111 (27) a current or former employee or contract staff
112112 member of a university health care provider at a corrections
113113 facility operated by the Texas Department of Criminal Justice or
114114 the Texas Juvenile Justice Department; and
115115 (28) a current or former attorney for the Department
116116 of Family and Protective Services.
117117 SECTION 2. This Act takes effect immediately if it receives
118118 a vote of two-thirds of all the members elected to each house, as
119119 provided by Section 39, Article III, Texas Constitution. If this
120120 Act does not receive the vote necessary for immediate effect, this
121121 Act takes effect September 1, 2023.
