55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a peace officer commissioned by the
88 comptroller to apply for an order authorizing the installation and
99 use of a mobile tracking device.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 18B.202(a), Code of Criminal Procedure,
1212 is amended to read as follows:
1313 (a) A district judge may issue an order for the installation
1414 and use of a mobile tracking device only on the application of:
1515 (1) an authorized peace officer; or
1616 (2) a peace officer commissioned by the comptroller.
1717 SECTION 2. This Act takes effect immediately if it receives
1818 a vote of two-thirds of all the members elected to each house, as
1919 provided by Section 39, Article III, Texas Constitution. If this
2020 Act does not receive the vote necessary for immediate effect, this
2121 Act takes effect September 1, 2023.
