8 | 8 | | comptroller to apply for an order authorizing the installation and |

9 | 9 | | use of a mobile tracking device. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Article 18B.202(a), Code of Criminal Procedure, |
---|
12 | 12 | | is amended to read as follows: |
---|
13 | 13 | | (a) A district judge may issue an order for the installation |
---|
14 | 14 | | and use of a mobile tracking device only on the application of: |
---|
15 | 15 | | (1) an authorized peace officer; or |
---|
16 | 16 | | (2) a peace officer commissioned by the comptroller. |
---|
17 | 17 | | SECTION 2. This Act takes effect immediately if it receives |
---|
18 | 18 | | a vote of two-thirds of all the members elected to each house, as |
---|
19 | 19 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
20 | 20 | | Act does not receive the vote necessary for immediate effect, this |
---|
21 | 21 | | Act takes effect September 1, 2023. |
