| 5 | 5 | | relating to the establishment of a new open-enrollment charter |

| 6 | 6 | | school campus by certain charter holders and to the expansion of an |

| 7 | 7 | | open-enrollment charter school. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 12.101(b-10), Education Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (b-10) The commissioner by rule shall allow a charter holder |
|---|
| 12 | 12 | | to provide written notice of the establishment of a new |
|---|
| 13 | 13 | | open-enrollment charter school campus under Subsection (b-4)(2) up |
|---|
| 14 | 14 | | to 36 [18] months before the date on which the campus is anticipated |
|---|
| 15 | 15 | | to open. Notice provided to the commissioner under this section |
|---|
| 16 | 16 | | does not obligate the charter holder to open a new campus. |
|---|
| 17 | 17 | | SECTION 2. Section 12.114(d), Education Code, is amended to |
|---|
| 18 | 18 | | read as follows: |
|---|
| 19 | 19 | | (d) A charter holder may submit a request for approval for |
|---|
| 20 | 20 | | an expansion amendment up to 36 [18] months before the date on which |
|---|
| 21 | 21 | | the expansion will be effective. A request for approval of an |
|---|
| 22 | 22 | | expansion amendment does not obligate the charter holder to |
|---|
| 23 | 23 | | complete the proposed expansion. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect September 1, 2023. |
