55 relating to the salary of certain employees who transfer within a
66 state agency.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter K, Chapter 659, Government Code, is
99 amended by adding Section 659.2532 to read as follows:
1010 Sec. 659.2532. TRANSFER WITHIN AGENCY BETWEEN CLASSIFIED
1111 POSITIONS WITH SAME POSITION TITLE WHEN EMPLOYEE IS COMPETITIVELY
1212 SELECTED. (a) In this section, "classified position" means a
1313 position classified under the state's position classification
1414 plan.
1515 (b) A state employee's annual salary rate immediately after
1616 a transfer may be set at any rate in the appropriate salary group if
1717 the employee:
1818 (1) transfers within a state agency between two
1919 classified positions that:
2020 (A) are allocated to the same salary group; and
2121 (B) have the same position title as listed in the
2222 General Appropriations Act;
2323 (2) transfers to a position for which the employment
2424 opening is publicly listed in accordance with Chapter 656;
2525 (3) voluntarily applies for the position to which the
2626 employee transfers; and
2727 (4) agrees to accept the position to which the
2828 employee transfers at the publicly listed salary.
2929 SECTION 2. Section 659.2532, Government Code, as added by
3030 this Act, applies only to a transfer of position that takes effect
3131 on or after September 1, 2023. A transfer of position that takes
3232 effect before September 1, 2023, is governed by the law in effect on
3333 the effective date of the transfer, and the former law is continued
3434 in effect for that purpose.
3535 SECTION 3. This Act takes effect September 1, 2023.
