| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 232.008(a), Local Government Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (a) This section applies only to real property located | |
| 13 | 13 | outside: | |
| 14 | 14 | (1) a municipality; [municipalities] and | |
| 15 | 15 | (2) the area in the extraterritorial jurisdiction of a | |
| 16 | 16 | municipality not subject to an agreement described by: | |
| 17 | 17 | (A) Section 242.001(d)(2); or | |
| 18 | 18 | (B) Section 242.001(d)(3) that apportions the | |
| 19 | 19 | area to a county [municipalities, as determined under Chapter 42]. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2023. |
