| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 48, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 48.008 to read as follows: |

| 12 | 12 | | Sec. 48.008. PROVISION OF ASSISTANCE IN OBTAINING CERTAIN |
|---|
| 13 | 13 | | ORDERS. (a) In this section, "family violence" has the meaning |
|---|
| 14 | 14 | | assigned by Section 71.004, Family Code. |
|---|
| 15 | 15 | | (b) The department shall provide to an elderly person at the |
|---|
| 16 | 16 | | elderly person's request assistance in obtaining a temporary ex |
|---|
| 17 | 17 | | parte order under Section 83.006, Family Code, to exclude from the |
|---|
| 18 | 18 | | elderly person's residence an individual who has committed an act |
|---|
| 19 | 19 | | of physical or verbal abuse against the elderly person that is |
|---|
| 20 | 20 | | alleged to constitute family violence. |
|---|
| 21 | 21 | | (c) The commissioner shall adopt rules as necessary to |
|---|
| 22 | 22 | | implement this section. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
