9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 341.0695, Health and Safety Code, is |
---|
11 | 11 | | amended by amending Subsection (d) and adding Subsections (i-2) and |
---|
12 | 12 | | (l) to read as follows: |
---|
13 | 13 | | (d) Except as provided by Subsection (f), a minimum free |
---|
14 | 14 | | residual chlorine of 2.0 parts [1.0 part] for each one million units |
---|
15 | 15 | | of water used in an interactive water feature or fountain must be |
---|
16 | 16 | | maintained. |
---|
17 | 17 | | (i-2) This subsection applies to a county with an |
---|
18 | 18 | | interactive water feature or fountain wholly or partly located in |
---|
19 | 19 | | the county's unincorporated area or a municipality with an |
---|
20 | 20 | | interactive water feature or fountain wholly located in the |
---|
21 | 21 | | municipality. For each interactive water feature or fountain |
---|
22 | 22 | | subject to this section, the applicable county or municipality |
---|
23 | 23 | | shall: |
---|
24 | 24 | | (1) require the person operating the interactive water |
---|
25 | 25 | | feature or fountain to manually test and record the feature's or |
---|
26 | 26 | | fountain's chemical levels every three to four hours during |
---|
27 | 27 | | operating hours; |
---|
28 | 28 | | (2) inspect the interactive water feature or fountain |
---|
29 | 29 | | at least twice annually for compliance with this subsection; and |
---|
30 | 30 | | (3) prepare a report containing the manual chemical |
---|
31 | 31 | | level test results recorded under Subdivision (1) and make the |
---|
32 | 32 | | report available to the public. |
---|
33 | 33 | | (l) An interactive water feature or fountain constructed |
---|
34 | 34 | | after December 31, 2023, must include a chemical controller system |
---|
35 | 35 | | and automatic shut-off valves for low chemical levels. |
---|
36 | 36 | | SECTION 2. This Act takes effect September 1, 2023. |
---|
