66 AN ACT
77 relating to the regulation and operation of an interactive water
88 feature or fountain.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 341.0695, Health and Safety Code, is
1111 amended by amending Subsection (d) and adding Subsections (i-2) and
1212 (l) to read as follows:
1313 (d) Except as provided by Subsection (f), a minimum free
1414 residual chlorine of 2.0 parts [1.0 part] for each one million units
1515 of water used in an interactive water feature or fountain must be
1616 maintained.
1717 (i-2) This subsection applies to a county with an
1818 interactive water feature or fountain wholly or partly located in
1919 the county's unincorporated area or a municipality with an
2020 interactive water feature or fountain wholly located in the
2121 municipality. For each interactive water feature or fountain
2222 subject to this section, the applicable county or municipality
2323 shall:
2424 (1) require the person operating the interactive water
2525 feature or fountain to manually test and record the feature's or
2626 fountain's chemical levels every three to four hours during
2727 operating hours;
2828 (2) inspect the interactive water feature or fountain
2929 at least twice annually for compliance with this subsection; and
3030 (3) prepare a report containing the manual chemical
3131 level test results recorded under Subdivision (1) and make the
3232 report available to the public.
3333 (l) An interactive water feature or fountain constructed
3434 after December 31, 2023, must include a chemical controller system
3535 and automatic shut-off valves for low chemical levels.
3636 SECTION 2. This Act takes effect September 1, 2023.
