88R7251 LRM-D By: Turner H.B. No. 2255 A BILL TO BE ENTITLED AN ACT relating to the regulation and operation of an interactive water feature or fountain. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 341.0695, Health and Safety Code, is amended by amending Subsection (d) and adding Subsections (i-2) and (l) to read as follows: (d) Except as provided by Subsection (f), a minimum free residual chlorine of 2.0 parts [1.0 part] for each one million units of water used in an interactive water feature or fountain must be maintained. (i-2) This subsection applies to a county with an interactive water feature or fountain wholly or partly located in the county's unincorporated area or a municipality with an interactive water feature or fountain wholly located in the municipality. For each interactive water feature or fountain subject to this section, the applicable county or municipality shall: (1) require the person operating the interactive water feature or fountain to manually test and record the feature's or fountain's chemical levels every three to four hours during operating hours; (2) inspect the interactive water feature or fountain at least twice annually for compliance with this subsection; and (3) prepare a report containing the manual chemical level test results recorded under Subdivision (1) and make the report available to the public. (l) An interactive water feature or fountain constructed after December 31, 2023, must include a chemical controller system and automatic shut-off valves for low chemical levels. SECTION 2. This Act takes effect September 1, 2023.
