12 | 12 | | SECTION 1. Article 42A.560, Code of Criminal Procedure, is |

13 | 13 | | amended by adding Subsection (d) to read as follows: |
---|
14 | 14 | | (d) In this article, "terminally ill" means having an |
---|
15 | 15 | | incurable illness or condition that is expected to result in death |
---|
16 | 16 | | within one year regardless of life-sustaining treatment. |

17 | 17 | | SECTION 2. Article 42A.561, Code of Criminal Procedure, is |
---|
18 | 18 | | amended by adding Subsection (c) to read as follows: |

19 | 19 | | (c) In this article, "terminally ill" means having an |
---|
20 | 20 | | incurable illness or condition that is expected to result in death |
---|
21 | 21 | | within one year regardless of life-sustaining treatment. |

22 | 22 | | SECTION 3. Section 508.146, Government Code, is amended by |
---|
23 | 23 | | adding Subsection (g) to read as follows: |

24 | 24 | | (g) In this section, "terminally ill" means having an |
---|
25 | 25 | | incurable illness or condition that is expected to result in death |
---|
26 | 26 | | within one year regardless of life-sustaining treatment. |

27 | 27 | | SECTION 4. This Act takes effect September 1, 2023. |
