| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Article 42A.560, Code of Criminal Procedure, is |

| 13 | 13 | | amended by adding Subsection (d) to read as follows: |
|---|
| 14 | 14 | | (d) In this article, "terminally ill" means having an |
|---|
| 15 | 15 | | incurable illness or condition that is expected to result in death |
|---|
| 16 | 16 | | within one year regardless of life-sustaining treatment. |

| 17 | 17 | | SECTION 2. Article 42A.561, Code of Criminal Procedure, is |

| 18 | 18 | | amended by adding Subsection (c) to read as follows: |

| 19 | 19 | | (c) In this article, "terminally ill" means having an |
|---|
| 20 | 20 | | incurable illness or condition that is expected to result in death |
|---|
| 21 | 21 | | within one year regardless of life-sustaining treatment. |

| 22 | 22 | | SECTION 3. Section 508.146, Government Code, is amended by |

| 23 | 23 | | adding Subsection (g) to read as follows: |
