88 AN ACT
99 relating to the medical release of certain terminally ill
1010 defendants and inmates.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 42A.560, Code of Criminal Procedure, is
1313 amended by adding Subsection (d) to read as follows:
1414 (d) In this article, "terminally ill" means having an
1515 incurable illness or condition that is expected to result in death
1616 within one year regardless of life-sustaining treatment.
1717 SECTION 2. Article 42A.561, Code of Criminal Procedure, is
1818 amended by adding Subsection (c) to read as follows:
1919 (c) In this article, "terminally ill" means having an
2020 incurable illness or condition that is expected to result in death
2121 within one year regardless of life-sustaining treatment.
2222 SECTION 3. Section 508.146, Government Code, is amended by
2323 adding Subsection (g) to read as follows:
2424 (g) In this section, "terminally ill" means having an
2525 incurable illness or condition that is expected to result in death
2626 within one year regardless of life-sustaining treatment.
2727 SECTION 4. This Act takes effect September 1, 2023.
