55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the permissible uses of the school safety allotment and
88 the creation of a mental health allotment under the Foundation
99 School Program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 48.115(b), Education Code, is amended to
1212 read as follows:
1313 (b) Funds allocated under this section must be used to
1414 improve school safety and security, including costs associated
1515 with:
1616 (1) securing school facilities, including:
1717 (A) improvements to school infrastructure;
1818 (B) the use or installation of physical barriers;
1919 and
2020 (C) the purchase and maintenance of:
2121 (i) security cameras or other security
2222 equipment; and
2323 (ii) technology, including communications
2424 systems or devices, that facilitates communication and information
2525 sharing between students, school personnel, and first responders in
2626 an emergency;
2727 (2) providing security for the district, including:
2828 (A) employing school district peace officers,
2929 private security officers, and school marshals; and
3030 (B) collaborating with local law enforcement
3131 agencies, such as entering into a memorandum of understanding for
3232 the assignment of school resource officers to schools in the
3333 district; and
3434 (3) school safety and security training and planning,
3535 including:
3636 (A) active shooter and emergency response
3737 training;
3838 (B) prevention and treatment programs relating
3939 to addressing adverse childhood experiences; and
4040 (C) the prevention, identification, and
4141 management of emergencies and threats, using evidence-based,
4242 effective prevention practices and including the establishment of
4343 [:
4444 [(i) providing licensed counselors, social
4545 workers, and individuals trained in restorative discipline and
4646 restorative justice practices;
4747 [(ii) providing mental health personnel and
4848 support;
4949 [(iii) providing behavioral health
5050 services;
5151 [(iv) establishing] threat reporting
5252 systems[; and
5353 [(v) developing and implementing programs
5454 focused on restorative justice practices, culturally relevant
5555 instruction, and providing mental health support; and
5656 [(4) providing programs related to suicide
5757 prevention, intervention, and postvention].
5858 SECTION 2. Subchapter C, Chapter 48, Education Code, is
5959 amended by adding Section 48.117 to read as follows:
6060 Sec. 48.117. MENTAL HEALTH ALLOTMENT. (a) A school
6161 district is entitled to an annual allotment of $100,000 or a greater
6262 amount provided by appropriation to support mental health services
6363 at the district.
6464 (b) In addition to the allotment under Subsection (a), a
6565 school district that receives an allotment under Section 48.101 or
6666 at which more than 50 percent of enrolled students are
6767 educationally disadvantaged is entitled to an allotment for each
6868 student enrolled in the district in an amount provided by
6969 appropriation.
7070 (c) Funds allocated under this section:
7171 (1) must be used to develop or enhance a comprehensive
7272 school mental health system that, through the implementation of
7373 programs, practices, and procedures in accordance with Section
7474 38.351, provides a tiered array of supports and services in the
7575 educational setting that contribute to:
7676 (A) a positive school climate;
7777 (B) the development of skills related to managing
7878 emotions, establishing and maintaining positive relationships, and
7979 responsible decision-making;
8080 (C) the learning and well-being of students with
8181 or at risk of mental health or substance use conditions;
8282 (D) family and community engagement;
8383 (E) reduced exclusionary discipline practices;
8484 and
8585 (F) staff wellness; and
8686 (2) may be used to pay for costs associated with:
8787 (A) the salary of school personnel responsible
8888 for planning, coordinating, delivering, or monitoring supports and
8989 services described by Subdivision (1);
9090 (B) training school personnel regarding
9191 effective practices and district and campus procedures to support
9292 student mental health;
9393 (C) a contract-based collaborative effort or
9494 partnership with one or more local community programs, agencies, or
9595 providers; and
9696 (D) developing and implementing programs focused
9797 on restorative justice practices.
9898 (d) Funds allocated for purposes of this section may not be
9999 used to supplant any other funds that may be provided for the same
100100 purpose.
101101 (e) Not later than June 1 of each year and in accordance with
102102 commissioner rule, each school district shall submit to the
103103 commissioner information regarding the outcomes and expenditures
104104 related to funds allocated to the district under this section.
105105 (f) Not later than September 1 of each year, the
106106 commissioner shall publish a report regarding the use of funds
107107 allocated under this section during the preceding school year,
108108 including information regarding the programs, personnel, and
109109 resources implemented, employed, or purchased by school districts
110110 using the funds and other purposes for which the funds were used.
111111 SECTION 3. This Act takes effect September 1, 2023.
