2424 relating to the permitting of medical waste facilities by the Texas
2525 Commission on Environmental Quality.
2626 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
2727 SECTION 1. Section 361.0905, Health and Safety Code, is
2828 amended by amending Subsection (e) and adding Subsections (e-1) and
2929 (e-2) to read as follows:
3030 (e) Except as provided by Subsection (e-1), rules [Rules]
3131 adopted to regulate the operation of municipal solid waste storage
3232 and processing units apply in the same manner to medical waste only
3333 to the extent that the rules address:
3434 (1) permit and registration requirements that can be
3535 made applicable to a facility that handles medical waste, including
3636 requirements related to:
3737 (A) applications;
3838 (B) site development;
3939 (C) notice; and
4040 (D) permit or registration duration and limits;
4141 (2) minor modifications to permits and registrations,
4242 including changes in operating hours and buffer zones;
4343 (3) the reconciliation of conflicting site operation
4444 plan provisions for a site that conducts activities that require a
4545 separate permit or authorization;
4646 (4) waste acceptance and analysis;
4747 (5) facility-generated waste, including wastewater
4848 and sludge;
4949 (6) contaminated water management;
5050 (7) on-site storage areas for source-separated or
5151 recyclable materials;
5252 (8) the storage of waste:
5353 (A) to prevent the waste from becoming a hazard,
5454 including a fire hazard, to human health or safety;
5555 (B) to ensure the use of sufficient containers
5656 between collections; and
5757 (C) to prevent the waste from becoming litter;
5858 (9) closure requirements for storage and processing
5959 units;
6060 (10) recordkeeping and reporting requirements, except
6161 for rules regarding the recordkeeping provisions required to
6262 justify the levels of recovered recycled products;
6363 (11) fire protection;
6464 (12) access control;
6565 (13) unloading waste;
6666 (14) spill prevention and control;
6767 (15) operating hours;
6868 (16) facility signage;
6969 (17) control of litter, including windblown material;
7070 (18) noise pollution and visual screening;
7171 (19) capacity overloading and mechanical breakdown;
7272 (20) sanitation, including employee sanitation
7373 facilities;
7474 (21) ventilation and air pollution control, except as
7575 those rules apply to:
7676 (A) process areas where putrescible waste is
7777 processed;
7878 (B) the minimal air exposure for liquid waste;
7979 and
8080 (C) the cleaning and maintenance of mobile waste
8181 processing unit equipment; and
8282 (22) facility health and safety plans, including
8383 employee training in health and safety.
8484 (e-1) Not later than the 30th day after the date of filing an
8585 application for, or notice of intent to file an application for, a
8686 permit to construct, operate, or maintain a facility to store,
8787 process, or dispose of medical waste, the applicant shall provide
8888 notice of the application or notice of intent by hand delivery,
8989 facsimile, or United States Postal Service mail to:
9090 (1) the state senator and representative who represent
9191 the area in which the facility is or is to be located;
9292 (2) the commissioners court of the county in which the
9393 facility is or is to be located; and
9494 (3) the governing body of the municipality in which
9595 the facility is or is to be located, if applicable.
9696 (e-2) The applicant shall submit to the commission proof
9797 that notice has been provided in accordance with Subsection (e-1).
9898 SECTION 2. Sections 361.0905(e-1) and (e-2), Health and
9999 Safety Code, as added by this Act, apply only to an application
100100 related to a permit for a medical waste facility that is submitted
101101 to the Texas Commission on Environmental Quality on or after the
102102 effective date of this Act. An application related to a permit for
103103 a medical waste facility that was submitted to the Texas Commission
104104 on Environmental Quality before the effective date of this Act is
105105 governed by the law in effect at the time the application was filed,
106106 and the former law is continued in effect for that purpose.
107107 SECTION 3. This Act takes effect September 1, 2023.
