77 relating to the continuation and duties of the Sexual Assault
88 Survivors' Task Force and establishment of a mandatory training
99 program for peace officers on responding to reports of child sexual
1010 abuse and adult sexual assault.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 772.0064(m), Government Code, is amended
1313 to read as follows:
1414 (m) Chapter 2110 does not apply to the composition or
1515 duration of the task force or to the designation of the task force's
1616 presiding officer [This section expires September 1, 2023].
1717 SECTION 2. Section 1701.253, Occupations Code, is amended
1818 by adding Subsection (q) to read as follows:
1919 (q) As part of the minimum curriculum requirements, the
2020 commission shall require an officer to complete the basic education
2121 and training program developed under Section 1701.272. An officer
2222 shall complete the program not later than the last day of the first
2323 full continuing education training period after the date the
2424 officer is licensed under this chapter unless the officer completes
2525 the program as part of the officer's basic training course.
2626 SECTION 3. Subchapter F, Chapter 1701, Occupations Code, is
2727 amended by adding Section 1701.272 to read as follows:
2828 Sec. 1701.272. TRAINING PROGRAM ON RESPONDING TO SEXUAL
2929 ABUSE OR ASSAULT. (a) The commission shall, in consultation with
3030 the Sexual Assault Survivors' Task Force established under Section
3131 772.0064, Government Code, establish a basic education and training
3232 program on child sexual abuse and adult sexual assault, including
3333 the use of best practices and techniques to effectively recognize,
3434 investigate, and document those cases. The training program must
3535 consist of at least eight hours of instruction.
3636 (b) The commission shall require an officer to complete the
3737 training program unless the officer has completed the training
3838 under Section 1701.253(q) or other training equivalent to the
3939 training program as determined by the commission.
4040 SECTION 4. Section 1701.253(b-2), Occupations Code, is
4141 repealed.
4242 SECTION 5. Not later than January 1, 2024, the Texas
4343 Commission on Law Enforcement shall establish the training program
4444 required by Section 1701.272, Occupations Code, as added by this
4545 Act.
4646 SECTION 6. The minimum curriculum requirements under
4747 Section 1701.253(q), Occupations Code, as added by this Act, apply
4848 only to an officer who first begins to satisfy those requirements on
4949 or after January 1, 2024.
5050 SECTION 7. This Act takes effect September 1, 2023.
