| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 772.0064(m), Government Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (m) Chapter 2110 does not apply to the composition or |
|---|
| 15 | 15 | | duration of the task force or to the designation of the task force's |
|---|
| 16 | 16 | | presiding officer [This section expires September 1, 2023]. |

| 17 | 17 | | SECTION 2. Section 1701.253, Occupations Code, is amended |
|---|
| 18 | 18 | | by adding Subsection (q) to read as follows: |
|---|
| 19 | 19 | | (q) As part of the minimum curriculum requirements, the |
|---|
| 20 | 20 | | commission shall require an officer to complete the basic education |
|---|
| 21 | 21 | | and training program developed under Section 1701.272. An officer |
|---|
| 22 | 22 | | shall complete the program not later than the last day of the first |
|---|
| 23 | 23 | | full continuing education training period after the date the |
|---|
| 24 | 24 | | officer is licensed under this chapter unless the officer completes |
|---|
| 25 | 25 | | the program as part of the officer's basic training course. |
|---|
| 26 | 26 | | SECTION 3. Subchapter F, Chapter 1701, Occupations Code, is |
|---|
| 27 | 27 | | amended by adding Section 1701.272 to read as follows: |
|---|
| 28 | 28 | | Sec. 1701.272. TRAINING PROGRAM ON RESPONDING TO SEXUAL |
|---|
| 29 | 29 | | ABUSE OR ASSAULT. (a) The commission shall, in consultation with |
|---|
| 30 | 30 | | the Sexual Assault Survivors' Task Force established under Section |
|---|
| 31 | 31 | | 772.0064, Government Code, establish a basic education and training |
|---|
| 32 | 32 | | program on child sexual abuse and adult sexual assault, including |
|---|
| 33 | 33 | | the use of best practices and techniques to effectively recognize, |
|---|
| 34 | 34 | | investigate, and document those cases. The training program must |
|---|
| 35 | 35 | | consist of at least eight hours of instruction. |
|---|
| 36 | 36 | | (b) The commission shall require an officer to complete the |
|---|
| 37 | 37 | | training program unless the officer has completed the training |
|---|
| 38 | 38 | | under Section 1701.253(q) or other training equivalent to the |
|---|
| 39 | 39 | | training program as determined by the commission. |
|---|
| 40 | 40 | | SECTION 4. Section 1701.253(b-2), Occupations Code, is |
|---|
| 41 | 41 | | repealed. |
|---|
| 42 | 42 | | SECTION 5. Not later than January 1, 2024, the Texas |
|---|
| 43 | 43 | | Commission on Law Enforcement shall establish the training program |
|---|
| 44 | 44 | | required by Section 1701.272, Occupations Code, as added by this |
|---|
| 45 | 45 | | Act. |
|---|
| 46 | 46 | | SECTION 6. The minimum curriculum requirements under |
|---|
| 47 | 47 | | Section 1701.253(q), Occupations Code, as added by this Act, apply |
|---|
| 48 | 48 | | only to an officer who first begins to satisfy those requirements on |
|---|
| 49 | 49 | | or after January 1, 2024. |
|---|
| 50 | 50 | | SECTION 7. This Act takes effect September 1, 2023. |
