A BILL TO BE ENTITLED
AN ACT
relating to reporting of the names of the directors of water supply
or sewer service corporations; authorizing an administrative
penalty.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 13, Water Code, is amended
by adding Section 13.1361 to read as follows:
Sec. 13.1361. WATER SUPPLY OR SEWER SERVICE CORPORATION
REPORT OF DIRECTORS. (a) The utility commission by rule shall
require each water supply or sewer service corporation to:
(1) file with the utility commission a report naming
the directors of the corporation; and
(2) in a timely manner, update the report when a new
director is appointed or elected.
(b) The utility commission may impose a penalty under
Section 13.4151 for a failure to file a report required under this
section in an amount of not more than $5,000 for each report that is
not timely filed.
SECTION 2. This Act takes effect September 1, 2023.
