1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to a strategic plan for improving maternal health,
1313 including the consolidation and repeal of certain planning and
1414 reporting requirements.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1717 amended by adding Section 531.0223 to read as follows:
1818 Sec. 531.0223. MATERNAL HEALTH STRATEGIC PLAN. (a) The
1919 commission shall develop and implement a strategic plan for
2020 improving maternal health outcomes under programs administered by
2121 this state that provide services to women during and following a
2222 pregnancy. The strategic plan must include strategies for:
2323 (1) improving access to screening, referral,
2424 treatment, and support services for perinatal depression,
2525 hyperemesis gravidarum, and other major pregnancy-related health
2626 complications;
2727 (2) improving the quality of maternal health care
2828 provided under Medicaid, the child health plan perinatal program,
2929 other health care programs administered by this state, and state
3030 health plans; and
3131 (3) reducing pregnancy-related deaths, focusing on
3232 the most prevalent causes of those deaths.
3333 (b) In developing the strategic plan, the commission shall
3434 consult with the Department of State Health Services, the statewide
3535 health coordinating council, and other maternal health experts as
3636 the commission determines necessary.
3737 (c) Not later than December 31 of each even-numbered year,
3838 the commission shall provide the strategic plan developed under
3939 this section to the governor, the lieutenant governor, the speaker
4040 of the house of representatives, the Senate Health and Human
4141 Services Committee, the House Public Health Committee, and the
4242 House Human Services Committee.
4343 SECTION 2. Section 34.0155, Health and Safety Code, is
4444 amended to read as follows:
4545 Sec. 34.0155. OPTIONS AND STRATEGIES FOR REDUCING [REPORT
4646 ON] PREGNANCY-RELATED DEATHS, SEVERE MATERNAL MORBIDITY, AND
4747 POSTPARTUM DEPRESSION. The commission shall:
4848 (1) evaluate options for reducing pregnancy-related
4949 deaths, focusing on the most prevalent causes of pregnancy-related
5050 deaths as identified in the joint biennial report required under
5151 Section 34.015, and for treating postpartum depression in
5252 economically disadvantaged women; and
5353 (2) in coordination with the department and the review
5454 committee, identify strategies to:
5555 (A) lower costs of providing medical assistance
5656 under Chapter 32, Human Resources Code, related to severe maternal
5757 morbidity and chronic illness; and
5858 (B) improve quality outcomes related to the
5959 underlying causes of severe maternal morbidity and chronic
6060 illness[; and
6161 [(3) not later than December 1 of each even-numbered
6262 year, submit to the governor, the lieutenant governor, the speaker
6363 of the house of representatives, the Legislative Budget Board, and
6464 the appropriate standing committees of the legislature a written
6565 report that includes:
6666 [(A) a summary of the commission's and
6767 department's efforts to accomplish the tasks described by
6868 Subdivisions (1) and (2); and
6969 [(B) a summary of the report required by Section
7070 34.0156].
7171 SECTION 3. The following provisions of the Health and
7272 Safety Code are repealed:
7373 (1) Section 32.046;
7474 (2) Section 32.047;
7575 (3) Sections 32.155(d) and (e);
7676 (4) Section 34.0158; and
7777 (5) Section 34.020(f).
7878 SECTION 4. This Act takes effect September 1, 2023.
