88 AN ACT
99 relating to a study by the Texas Department of Transportation on the
1010 use of municipal impact fees for roadway facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 395, Local Government
1313 Code, is amended by adding Section 395.0115 to read as follows:
1414 Sec. 395.0115. STUDY OF MUNICIPAL IMPACT FEES TO PAY FOR
1515 ROADWAY FACILITIES. (a) The Texas Department of Transportation,
1616 in consultation with the Texas A&M Transportation Institute, shall
1717 conduct a study to determine the feasibility of using municipal
1818 impact fees to pay for roadway facilities that are necessary due to
1919 municipal development.
2020 (b) In conducting the study, the Texas Department of
2121 Transportation must consider:
2222 (1) the roadway facility needs of municipalities;
2323 (2) the amount of debt incurred by municipalities for
2424 roadway facilities;
2525 (3) the practicability of adopting impact fees for
2626 roadway facilities in a municipality's roadway plan, considering
2727 costs associated with fee imposition and collection;
2828 (4) the potential and known effects of the imposition
2929 and collection of impact fees on local transportation needs;
3030 (5) the potential and known effects of the imposition
3131 and collection of impact fees on the municipality's debt; and
3232 (6) the practicability and potential effects of
3333 remitting five percent of a municipality's impact fees to the
3434 department for the construction and maintenance of state highways
3535 attributable to development in the municipality.
3636 (c) From the results of the study the Texas Department of
3737 Transportation shall determine:
3838 (1) the population threshold of a municipality for
3939 which the imposition and collection of impact fees for roadway
4040 facilities in the municipality's roadway plan is administratively
4141 feasible;
4242 (2) viable alternatives to municipal impact fees in
4343 municipalities where the imposition and collection of impact fees
4444 is not administratively feasible; and
4545 (3) to what extent, if any, the adoption of impact fees
4646 would alleviate the debt burden of municipalities.
4747 (d) The Texas Department of Transportation shall provide
4848 the results of the study and the determinations under Subsection
4949 (c) to the members of the legislature not later than September 1,
5050 2024.
5151 (e) This section expires September 1, 2025.
5252 SECTION 2. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2023.
