55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the municipal regulation of HUD-code manufactured
88 homes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1201.008, Occupations Code, is amended
1111 by adding Subsections (g), (h), (i), (j), and (k) to read as
1212 follows:
1313 (g) Notwithstanding any other law, other than Subsections
1414 (h), (i), and (k), a municipality shall allow the placement of a new
1515 HUD-code manufactured home as a permitted use in all zoning
1616 classifications that allow detached residential single-family or
1717 duplex dwellings, if the owner of the HUD-code manufactured home
1818 elects to treat the manufactured home as real property under
1919 Section 1201.2055.
2020 (h) A municipality may adopt an ordinance, regulation, or
2121 other measure that requires a new HUD-code manufactured home
2222 elected to be treated as real property and used as a single-family
2323 or duplex dwelling to:
2424 (1) have a value equal to or greater than the median
2525 taxable value of each single-family dwelling located within 500
2626 feet of the lot on which the new HUD-code manufactured home is
2727 proposed to be placed, as determined by the most recent certified
2828 tax appraisal roll for the properties;
2929 (2) have exterior siding, roofing, foundation fascia,
3030 and fenestration compatible with each single-family dwelling
3131 located within 500 feet of the lot on which the new HUD-code
3232 manufactured home is proposed to be placed;
3333 (3) comply with the municipality's aesthetic, building
3434 setback, side and rear yard offset, subdivision control,
3535 architectural landscaping, square footage, and other site
3636 requirements that would apply to a single-family dwelling
3737 constructed on the site; or
3838 (4) be securely placed on a permanent foundation
3939 system.
4040 (i) For purposes of Subsection (h), the value of a HUD-code
4141 manufactured home is the taxable or initial sales value of the
4242 HUD-code manufactured home and the value of the lot after the
4343 placement of the HUD-code manufactured home on the lot.
4444 (j) A municipality may not adopt or enforce an ordinance,
4545 regulation, or other measure that imposes a requirement on a new
4646 HUD-code manufactured home elected to be treated as real property
4747 under Section 1201.2055 that is more stringent than the regulations
4848 that would apply to a new single-family or duplex dwelling
4949 constructed on the site.
5050 (k) This section does not:
5151 (1) limit the authority of a municipality to adopt an
5252 ordinance, regulation, or other measure to protect historic
5353 properties or historic districts; or
5454 (2) affect deed restrictions.
5555 SECTION 2. This Act takes effect September 1, 2023.
