88 AN ACT
99 relating to an indication on a voter's voter registration
1010 certificate that a voter is a veteran.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 13.122(a), Election Code, is amended to
1313 read as follows:
1414 (a) In addition to the other statements and spaces for
1515 entering information that appear on an officially prescribed
1616 registration application form, each official form must include:
1717 (1) the statement: "I understand that giving false
1818 information to procure a voter registration is perjury and a crime
1919 under state and federal law.";
2020 (2) a space for the applicant's registration number;
2121 (3) a space for the applicant's Texas driver's license
2222 number or number of a personal identification card issued by the
2323 Department of Public Safety;
2424 (4) a space for the applicant's telephone number;
2525 (5) a space for the applicant's social security
2626 number;
2727 (6) a space for the applicant's sex;
2828 (7) a statement indicating that the furnishing of the
2929 applicant's telephone number and sex is optional;
3030 (8) a space or box for indicating whether the
3131 applicant or voter is submitting new registration information or a
3232 change in current registration information;
3333 (9) a statement instructing a voter who is using the
3434 form to make a change in current registration information to enter
3535 the voter's name and the changed information in the appropriate
3636 spaces on the form;
3737 (10) a statement that if the applicant declines to
3838 register to vote, that fact will remain confidential and will be
3939 used only for voter registration purposes;
4040 (11) a statement that if the applicant does register
4141 to vote, information regarding the agency or office to which the
4242 application is submitted will remain confidential and will be used
4343 only for voter registration purposes;
4444 (12) a space or box for indicating whether the
4545 applicant is interested in working as an election judge;
4646 (13) a statement warning that a conviction for making
4747 a false statement may result in imprisonment for up to the maximum
4848 amount of time provided by law, a fine of up to the maximum amount
4949 provided by law, or both the imprisonment and the fine; [and]
5050 (14) a space or box for indicating whether the
5151 applicant served in the United States armed forces, including their
5252 reserve components, an auxiliary service of one of the branches of
5353 the armed forces, or the state military forces, and a statement
5454 acknowledging that this information is publicly available
5555 information; and
5656 (15) [(14)] any other voter registration information
5757 required by federal law or considered appropriate and required by
5858 the secretary of state.
5959 SECTION 2. Section 15.001(a), Election Code, is amended to
6060 read as follows:
6161 (a) Each voter registration certificate issued must
6262 contain:
6363 (1) the voter's name in the form indicated by the
6464 voter, subject to applicable requirements prescribed by Section
6565 13.002 and by rule of the secretary of state;
6666 (2) the voter's residence address or, if the residence
6767 has no address, the address at which the voter receives mail and a
6868 concise description of the location of the voter's residence;
6969 (3) the year of the voter's birth;
7070 (4) the number of the county election precinct in
7171 which the voter resides;
7272 (5) the voter's effective date of registration if an
7373 initial certificate;
7474 (6) the voter's registration number;
7575 (7) an indication of the period for which the
7676 certificate is issued;
7777 (8) a statement explaining the circumstances under
7878 which the voter will receive a new certificate;
7979 (9) a space for stamping the voter's political party
8080 affiliation;
8181 (10) a statement that voting with the certificate by a
8282 person other than the person in whose name the certificate is issued
8383 is a felony;
8484 (11) a space for the voter's signature;
8585 (12) a statement that the voter must sign the
8686 certificate personally, if able to sign, immediately on receipt;
8787 (13) a space for the voter to correct the information
8888 on the certificate followed by a signature line;
8989 (14) the statement: "If any information on this
9090 certificate changes or is incorrect, correct the information in the
9191 space provided, sign below, and return this certificate to the
9292 voter registrar.";
9393 (15) the registrar's mailing address and telephone
9494 number; [and]
9595 (16) the jurisdictional or distinguishing number for
9696 the following territorial units in which the voter resides, as
9797 determined by the voter registrar:
9898 (A) congressional district;
9999 (B) state senatorial district;
100100 (C) state representative district;
101101 (D) commissioners precinct;
102102 (E) justice precinct;
103103 (F) city election precinct; and
104104 (G) school district election precinct; and
105105 (17) an indication that the voter is a "veteran," if
106106 the voter stated on the voter's registration application that the
107107 voter served in the United States armed forces, including their
108108 reserve components, an auxiliary service of one of the branches of
109109 the armed forces, or the state military forces.
110110 SECTION 3. Section 18.005(a), Election Code, is amended to
111111 read as follows:
112112 (a) Each original and supplemental list of registered
113113 voters must:
114114 (1) contain the voter's name, date of birth, and
115115 registration number as provided by the statewide computerized voter
116116 registration list;
117117 (2) contain the voter's residence address, except as
118118 provided by Subsections (b) and (c);
119119 (3) be arranged alphabetically by voter name; [and]
120120 (4) contain the notation required by Section 15.111;
121121 and
122122 (5) contain an indication that the voter is a
123123 "veteran," if the voter stated on the voter's registration
124124 application that the voter served in the United States armed
125125 forces, including their reserve components, an auxiliary service of
126126 one of the branches of the armed forces, or the state military
127127 forces.
128128 SECTION 4. The change in law made by this Act to Section
129129 13.122(a), Election Code, applies only to a voter registration
130130 application distributed on or after September 1, 2023. A voter
131131 registration application distributed before September 1, 2023, is
132132 covered by the law in effect when the application was distributed,
133133 and the former law is continued in effect for that purpose.
134134 SECTION 5. This Act takes effect September 1, 2023.
