| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 170A.002, Health and Safety Code, is |
|---|
| 12 | 12 | | amended by adding Subsection (e) to read as follows: |
|---|
| 13 | 13 | | (e) Direct or indirect assistance provided to an individual |
|---|
| 14 | 14 | | for traveling outside of this state to obtain an abortion does not |
|---|
| 15 | 15 | | constitute a violation of this section. |

| 16 | 16 | | SECTION 2. Subchapter A, Chapter 171, Health and Safety |
|---|
| 17 | 17 | | Code, is amended by adding Section 171.009 to read as follows: |
|---|
| 18 | 18 | | Sec. 171.009. ASSISTANCE WITH OUT-OF-STATE TRAVEL. |
|---|
| 19 | 19 | | Notwithstanding any other law, a person may provide direct or |
|---|
| 20 | 20 | | indirect assistance to an individual for traveling outside of this |
|---|
| 21 | 21 | | state to obtain an abortion. |
|---|
| 22 | 22 | | SECTION 3. Section 171.208, Health and Safety Code, is |
|---|
| 23 | 23 | | amended by adding Subsection (a-1) to read as follows: |
|---|
| 24 | 24 | | (a-1) A civil action under Subsection (a)(2) or (3) may not |
|---|
| 25 | 25 | | be brought against a person for providing or intending to provide |
|---|
| 26 | 26 | | direct or indirect assistance to an individual for traveling |
|---|
| 27 | 27 | | outside of this state to obtain an abortion. |
|---|
| 28 | 28 | | SECTION 4. This Act takes effect September 1, 2023. |
