A BILL TO BE ENTITLED
AN ACT
relating to the applicability of certain laws to assistance
provided to an individual in obtaining an abortion outside of this
state.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 170A.002, Health and Safety Code, is
amended by adding Subsection (e) to read as follows:
(e) Direct or indirect assistance provided to an individual
for traveling outside of this state to obtain an abortion does not
constitute a violation of this section.
SECTION 2. Subchapter A, Chapter 171, Health and Safety
Code, is amended by adding Section 171.009 to read as follows:
Sec. 171.009. ASSISTANCE WITH OUT-OF-STATE TRAVEL.
Notwithstanding any other law, a person may provide direct or
indirect assistance to an individual for traveling outside of this
state to obtain an abortion.
SECTION 3. Section 171.208, Health and Safety Code, is
amended by adding Subsection (a-1) to read as follows:
(a-1) A civil action under Subsection (a)(2) or (3) may not
be brought against a person for providing or intending to provide
direct or indirect assistance to an individual for traveling
outside of this state to obtain an abortion.
SECTION 4. This Act takes effect September 1, 2023.
