| 5 | 5 | | relating to the authority of the Benbrook Water Authority to issue |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 8 | | SECTION 1. Section 12, Chapter 123, Acts of the 54th |
|---|
| 9 | 9 | | Legislature, Regular Session, 1955, is amended to read as follows: |
|---|
| 10 | 10 | | Sec. 12. After any bonds are authorized by the Authority, |
|---|
| 11 | 11 | | such bonds and the record relating to their issuance shall be |
|---|
| 12 | 12 | | submitted to the Attorney General for his examination as to the |
|---|
| 13 | 13 | | validity thereof. Where such bonds recite that they are secured by |
|---|
| 14 | 14 | | a pledge of the proceeds of a contract theretofore made between the |
|---|
| 15 | 15 | | Authority and any city or other governmental agency or district, a |
|---|
| 16 | 16 | | copy of such contract and the proceedings of the city or other |
|---|
| 17 | 17 | | governmental agency or district authorizing such contract shall |
|---|
| 18 | 18 | | also be submitted to the Attorney General. If such bonds have been |
|---|
| 19 | 19 | | authorized and if such contracts have been made in accordance with |
|---|
| 20 | 20 | | the Constitution and laws of the State of Texas he shall approve the |
|---|
| 21 | 21 | | bonds and such contracts, and the bonds then shall be registered by |
|---|
| 22 | 22 | | the Comptroller of Public Accounts. Thereafter, the bonds, and the |
|---|
| 23 | 23 | | contracts, if any shall be valid and binding and shall be |
|---|
| 24 | 24 | | incontestable for any cause. Section 49.181, Water Code, does not |
|---|
| 25 | 25 | | apply to the Authority. |
|---|
| 26 | 26 | | SECTION 2. (a) The legal notice of the intention to |
|---|
| 27 | 27 | | introduce this Act, setting forth the general substance of this |
|---|
| 28 | 28 | | Act, has been published as provided by law, and the notice and a |
|---|
| 29 | 29 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 30 | 30 | | officials, or entities to which they are required to be furnished |
|---|
| 31 | 31 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 32 | 32 | | Government Code. |
|---|
| 33 | 33 | | (b) The governor, one of the required recipients, has |
|---|
| 34 | 34 | | submitted the notice and Act to the Texas Commission on |
|---|
| 35 | 35 | | Environmental Quality. |
|---|
| 36 | 36 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 37 | 37 | | its recommendations relating to this Act with the governor, |
|---|
| 38 | 38 | | lieutenant governor, and speaker of the house of representatives |
|---|
| 39 | 39 | | within the required time. |
|---|
| 40 | 40 | | (d) All requirements of the constitution and laws of this |
|---|
| 41 | 41 | | state and the rules and procedures of the legislature with respect |
|---|
| 42 | 42 | | to the notice, introduction, and passage of this Act have been |
|---|
| 43 | 43 | | fulfilled and accomplished. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 48 | 48 | | Act takes effect September 1, 2023. |
