44 AN ACT
55 relating to the authority of the Benbrook Water Authority to issue
66 bonds.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 12, Chapter 123, Acts of the 54th
99 Legislature, Regular Session, 1955, is amended to read as follows:
1010 Sec. 12. After any bonds are authorized by the Authority,
1111 such bonds and the record relating to their issuance shall be
1212 submitted to the Attorney General for his examination as to the
1313 validity thereof. Where such bonds recite that they are secured by
1414 a pledge of the proceeds of a contract theretofore made between the
1515 Authority and any city or other governmental agency or district, a
1616 copy of such contract and the proceedings of the city or other
1717 governmental agency or district authorizing such contract shall
1818 also be submitted to the Attorney General. If such bonds have been
1919 authorized and if such contracts have been made in accordance with
2020 the Constitution and laws of the State of Texas he shall approve the
2121 bonds and such contracts, and the bonds then shall be registered by
2222 the Comptroller of Public Accounts. Thereafter, the bonds, and the
2323 contracts, if any shall be valid and binding and shall be
2424 incontestable for any cause. Section 49.181, Water Code, does not
2525 apply to the Authority.
2626 SECTION 2. (a) The legal notice of the intention to
2727 introduce this Act, setting forth the general substance of this
2828 Act, has been published as provided by law, and the notice and a
2929 copy of this Act have been furnished to all persons, agencies,
3030 officials, or entities to which they are required to be furnished
3131 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3232 Government Code.
3333 (b) The governor, one of the required recipients, has
3434 submitted the notice and Act to the Texas Commission on
3535 Environmental Quality.
3636 (c) The Texas Commission on Environmental Quality has filed
3737 its recommendations relating to this Act with the governor,
3838 lieutenant governor, and speaker of the house of representatives
3939 within the required time.
4040 (d) All requirements of the constitution and laws of this
4141 state and the rules and procedures of the legislature with respect
4242 to the notice, introduction, and passage of this Act have been
4343 fulfilled and accomplished.
4444 SECTION 3. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2023.
