| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 161, Health and Safety |

| 11 | 11 | | Code, is amended by adding Section 161.0876 to read as follows: |

| 12 | 12 | | Sec. 161.0876. UNLAWFUL SALE OR TRANSFER OF SINGLE-USE |
|---|
| 13 | 13 | | E-CIGARETTE PRODUCTS. (a) In this section, "single-use |
|---|
| 14 | 14 | | e-cigarette product" means an e-cigarette that is: |
|---|
| 15 | 15 | | (1) prefilled with a consumable liquid solution or |
|---|
| 16 | 16 | | other material aerosolized or vaporized during use of the |
|---|
| 17 | 17 | | e-cigarette; and |
|---|
| 18 | 18 | | (2) designed to be discarded after the liquid solution |
|---|
| 19 | 19 | | or other material is depleted. |
|---|
| 20 | 20 | | (b) A person commits an offense if the person sells, gives, |
|---|
| 21 | 21 | | delivers, or furnishes a single-use e-cigarette product to another |
|---|
| 22 | 22 | | person. |
|---|
| 23 | 23 | | (c) An offense under this section is a Class B misdemeanor. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
