A BILL TO BE ENTITLED
AN ACT
relating to creating a criminal offense for the unlawful sale or
transfer of a single-use e-cigarette product.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter H, Chapter 161, Health and Safety
Code, is amended by adding Section 161.0876 to read as follows:
Sec. 161.0876. UNLAWFUL SALE OR TRANSFER OF SINGLE-USE
E-CIGARETTE PRODUCTS. (a) In this section, "single-use
e-cigarette product" means an e-cigarette that is:
(1) prefilled with a consumable liquid solution or
other material aerosolized or vaporized during use of the
e-cigarette; and
(2) designed to be discarded after the liquid solution
or other material is depleted.
(b) A person commits an offense if the person sells, gives,
delivers, or furnishes a single-use e-cigarette product to another
person.
(c) An offense under this section is a Class B misdemeanor.
SECTION 2. This Act takes effect September 1, 2023.
