| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 12, Agriculture Code, is amended by |
|---|
| 11 | 11 | | adding Section 12.052 to read as follows: |
|---|
| 12 | 12 | | Sec. 12.052. EMERGENCY FOOD ASSISTANCE PROGRAM. In |
|---|
| 13 | 13 | | administering the emergency food assistance program under Section |
|---|
| 14 | 14 | | 12.0025, the department shall include in the eligibility criteria |
|---|
| 15 | 15 | | for replacing perishable foods households that are located in an |
|---|
| 16 | 16 | | area declared to be a disaster area by the governor or the president |
|---|
| 17 | 17 | | of the United States. |
|---|
| 18 | 18 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 19 | 19 | | of this Act, the Department of Agriculture shall adopt rules |
|---|
| 20 | 20 | | necessary to implement the changes in law made by this Act. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 22 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 24 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 25 | | Act takes effect September 1, 2023. |
