A BILL TO BE ENTITLED
AN ACT
relating to the emergency food assistance program administered by
the Department of Agriculture.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 12, Agriculture Code, is amended by
adding Section 12.052 to read as follows:
Sec. 12.052. EMERGENCY FOOD ASSISTANCE PROGRAM. In
administering the emergency food assistance program under Section
12.0025, the department shall include in the eligibility criteria
for replacing perishable foods households that are located in an
area declared to be a disaster area by the governor or the president
of the United States.
SECTION 2. As soon as practicable after the effective date
of this Act, the Department of Agriculture shall adopt rules
necessary to implement the changes in law made by this Act.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2023.
