55 AN ACT
66 relating to requiring a security plan for certain alcoholic
77 beverage permit applications.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 11, Alcoholic Beverage
1010 Code, is amended by adding Section 11.341 to read as follows:
1111 Sec. 11.341. REQUIRED SECURITY PLAN. (a) An application
1212 for an original or renewal permit authorizing the sale of alcoholic
1313 beverages for on-premises consumption must include a security plan.
1414 (b) The security plan must include information regarding:
1515 (1) the type and location of cameras installed on the
1616 premises;
1717 (2) an emergency evacuation plan;
1818 (3) on-site security personnel, including the use of
1919 security guards or a licensed security service; and
2020 (4) any other information the commission determines
2121 necessary.
2222 (c) The commission shall adopt rules to implement this
2323 section, including rules requiring the applicant or permit holder
2424 to notify the commission of any updates or changes to the
2525 applicant's or permit holder's security plan.
2626 SECTION 2. Section 11.341, Alcoholic Beverage Code, as
2727 added by this Act, applies to an application for an alcoholic
2828 beverage permit filed on or after the effective date of this Act.
2929 An application for an alcoholic beverage permit filed before the
3030 effective date of this Act is governed by the law in effect on the
3131 date the application is filed, and the former law is continued in
3232 effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2023.
