| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 545.001(2), Transportation Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (2) "Pass" or "passing" used in reference to a vehicle |
|---|
| 11 | 11 | | means: |
|---|
| 12 | 12 | | (A) to: |
|---|
| 13 | 13 | | (i) overtake and proceed past another |
|---|
| 14 | 14 | | vehicle moving in the same direction as the passing vehicle; and |
|---|
| 15 | 15 | | (ii) return to the original lane of travel; |
|---|
| 16 | 16 | | or |
|---|
| 17 | 17 | | (B) to attempt the [that] maneuver described by |
|---|
| 18 | 18 | | Paragraph (A). |

| 19 | 19 | | SECTION 2. This Act takes effect September 1, 2023. |
