H.B. No. 3126
AN ACT
relating to the definitions of "pass" and "passing" used in
reference to a vehicle.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 545.001(2), Transportation Code, is
amended to read as follows:
(2) "Pass" or "passing" used in reference to a vehicle
means:
(A) to:
(i) overtake and proceed past another
vehicle moving in the same direction as the passing vehicle; and
(ii) return to the original lane of travel;
or
(B) to attempt the [that] maneuver described by
Paragraph (A).
SECTION 2. This Act takes effect September 1, 2023.
