55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of on-site sewage disposal systems,
88 including requiring a license for on-site sewage disposal system
99 pumping technicians.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 366.001, Health and Safety Code, is
1212 amended to read as follows:
1313 Sec. 366.001. POLICY AND PURPOSE. It is the public policy
1414 of this state and the purpose of this chapter to:
1515 (1) eliminate and prevent health hazards by regulating
1616 and properly planning the location, design, construction,
1717 installation, operation, pumping, and maintenance of on-site
1818 sewage disposal systems;
1919 (2) authorize the commission or authorized agent to
2020 impose and collect a permit fee for:
2121 (A) construction, installation, alteration,
2222 repair, or extension of on-site sewage disposal systems; and
2323 (B) tests, designs, and inspections of those
2424 systems;
2525 (3) authorize the commission or authorized agent to
2626 impose a penalty for a violation of this chapter or a rule adopted
2727 under this chapter;
2828 (4) authorize the commission to license or register
2929 certain persons; and
3030 (5) allow the individual owner of a disposal system to
3131 install and repair the system in accordance with this chapter.
3232 SECTION 2. Section 366.052(a), Health and Safety Code, is
3333 amended to read as follows:
3434 (a) Sections 366.051, 366.053, 366.054, and 366.057 do not
3535 apply to an on-site sewage disposal system of a single residence
3636 that is located on a land tract that is:
3737 (1) 10 acres or larger in which the field line or
3838 sewage disposal line is not closer than 100 feet of the property
3939 line; and
4040 (2) in a county with a population of less than 40,000.
4141 SECTION 3. Sections 366.071(a) and (d), Health and Safety
4242 Code, are amended to read as follows:
4343 (a) A person who constructs, installs, alters, extends,
4444 services, maintains, pumps, or repairs an on-site sewage disposal
4545 system or any part of an on-site sewage disposal system for
4646 compensation must hold a license or registration issued by the
4747 commission under Chapter 37, Water Code.
4848 (d) The commission may implement a program under Chapter 37,
4949 Water Code, to register persons who service, pump, or maintain
5050 on-site sewage disposal systems for compensation.
5151 SECTION 4. Section 366.052(a), Health and Safety Code, as
5252 amended by this Act, applies only to a residence for which
5353 construction begins on or after the effective date of this Act. A
5454 residence for which construction began before the effective date of
5555 this Act is governed by the law in effect when construction began,
5656 and the former law is continued in effect for that purpose.
5757 SECTION 5. Not later than September 1, 2024, the Texas
5858 Commission on Environmental Quality shall adopt rules implementing
5959 Section 366.071(a), Health and Safety Code, as amended by this Act.
6060 The rules must provide for the creation of an on-site sewage
6161 disposal system pumping technician license or registration and the
6262 requirements and qualifications to obtain the license or
6363 registration.
6464 SECTION 6. (a) Except as provided by Subsection (b) of this
6565 section, this Act takes effect September 1, 2023.
6666 (b) Section 366.071(a), Health and Safety Code, as amended
6767 by this Act, takes effect September 1, 2024.
