8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. This Act may be cited as the Citizens' Civil |
---|
10 | 10 | | Liberties Act. |
---|
11 | 11 | | SECTION 2. Article 14.01, Code of Criminal Procedure, is |
---|
12 | 12 | | amended to read as follows: |

13 | 13 | | Art. 14.01. OFFENSE WITHIN VIEW. (a) A person who is a |
---|
14 | 14 | | commissioned or noncommissioned security officer licensed under |
---|
15 | 15 | | Chapter 1702, Occupations Code, and is engaged in the performance |
---|
16 | 16 | | of the person's duties as a security officer [peace officer or any |
---|
17 | 17 | | other person,] may, without a warrant, arrest an offender when the |
---|
18 | 18 | | offense is committed in the person's [his] presence or within the |
---|
19 | 19 | | person's [his] view, if the offense is one classed as a felony or as |
---|
20 | 20 | | an offense against the public peace. |
---|
21 | 21 | | (b) A peace officer may arrest an offender without a warrant |
---|
22 | 22 | | for any offense committed in the peace officer's [his] presence or |
---|
23 | 23 | | within the peace officer's [his] view. |
---|
24 | 24 | | SECTION 3. This Act takes effect September 1, 2023. |
