66 AN ACT
77 relating to the authority to arrest a person without a warrant.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. This Act may be cited as the Citizens' Civil
1010 Liberties Act.
1111 SECTION 2. Article 14.01, Code of Criminal Procedure, is
1212 amended to read as follows:
1313 Art. 14.01. OFFENSE WITHIN VIEW. (a) A person who is a
1414 commissioned or noncommissioned security officer licensed under
1515 Chapter 1702, Occupations Code, and is engaged in the performance
1616 of the person's duties as a security officer [peace officer or any
1717 other person,] may, without a warrant, arrest an offender when the
1818 offense is committed in the person's [his] presence or within the
1919 person's [his] view, if the offense is one classed as a felony or as
2020 an offense against the public peace.
2121 (b) A peace officer may arrest an offender without a warrant
2222 for any offense committed in the peace officer's [his] presence or
2323 within the peace officer's [his] view.
2424 SECTION 3. This Act takes effect September 1, 2023.
