55 AN ACT
66 relating to certain burdens of proof in determining a defendant's
77 insanity in a criminal case.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. This Act may be cited as the Kishana Mitchell
1010 Act.
1111 SECTION 2. Article 46C.153, Code of Criminal Procedure, is
1212 amended by adding Subsection (a-1) to read as follows:
1313 (a-1) The burden of proof described by Subsection (a)(2)
1414 applies in a defendant's case regardless of any previous acquittal
1515 of the defendant by reason of insanity or another prior judgment of
1616 a court indicating the defendant's lack of sanity.
1717 SECTION 3. The changes in law made by this Act apply only to
1818 a trial or case relating to an offense committed on or after the
1919 effective date of this Act. A trial or case relating to an offense
2020 committed before the effective date of this Act is governed by the
2121 law in effect when the offense was committed, and the former law is
2222 continued in effect for that purpose. For purposes of this section,
2323 an offense was committed before the effective date of this Act if
2424 any element of the offense occurred before that date.
2525 SECTION 4. This Act takes effect September 1, 2023.
