8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 12.104(b), Education Code, as amended by |

10 | 10 | | Chapters 542 (S.B. 168), 887 (S.B. 1697), 915 (H.B. 3607), 974 (S.B. |

11 | 11 | | 2081), and 1046 (S.B. 1365), Acts of the 87th Legislature, Regular |
---|
12 | 12 | | Session, 2021, is reenacted and amended to read as follows: |

13 | 13 | | (b) An open-enrollment charter school is subject to: |

76 | 76 | | SECTION 2. Subchapter D, Chapter 37, Education Code, is |
---|
77 | 77 | | amended by adding Section 37.116 to read as follows: |

78 | 78 | | Sec. 37.116. EMERGENCY RESPONSE TRAINING. (a) A school |
---|
79 | 79 | | district may require each principal, assistant principal, school |
---|
80 | 80 | | marshal, school district peace officer, school resource officer, |
---|
81 | 81 | | and school security personnel employed by or assigned to the |
---|
82 | 82 | | district to complete the following emergency response management |
---|
83 | 83 | | training courses provided by the Federal Emergency Management |
---|
84 | 84 | | Agency: |
---|
85 | 85 | | (1) Introduction to the Incident Command System; |
---|
86 | 86 | | (2) Basic Incident Command System for Initial |
---|
87 | 87 | | Response; |
---|
88 | 88 | | (3) An Introduction to the National Incident |
---|
89 | 89 | | Management System; and |
---|
90 | 90 | | (4) National Response Framework, An Introduction. |
---|
91 | 91 | | (b) The board of trustees of a school district that requires |
---|
92 | 92 | | the completion of training courses under Subsection (a) shall adopt |
---|
93 | 93 | | policies to: |
---|
94 | 94 | | (1) verify completion of the training by each person |
---|
95 | 95 | | required to complete the training under Subsection (a); and |
---|
96 | 96 | | (2) provide annual emergency response management |
---|
97 | 97 | | training exercises incorporating the training required under |
---|
98 | 98 | | Subsection (a). |
---|
99 | 99 | | SECTION 3. To the extent of any conflict, this Act prevails |
---|
100 | 100 | | over another Act of the 88th Legislature, Regular Session, 2023, |
---|
101 | 101 | | relating to nonsubstantive additions to and corrections in enacted |
---|
102 | 102 | | codes. |
---|
103 | 103 | | SECTION 4. This Act applies beginning with the 2023-2024 |
---|
104 | 104 | | school year. |
---|
105 | 105 | | SECTION 5. This Act takes effect immediately if it receives |
---|
106 | 106 | | a vote of two-thirds of all the members elected to each house, as |
---|
107 | 107 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
108 | 108 | | Act does not receive the vote necessary for immediate effect, this |
---|
109 | 109 | | Act takes effect September 1, 2023. |
