5	5	AN ACT
6	6	relating to emergency response management training for certain
7	7	administrators and security personnel at public schools.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 12.104(b), Education Code, as amended by
10	10	Chapters 542 (S.B. 168), 887 (S.B. 1697), 915 (H.B. 3607), 974 (S.B.
11	11	2081), and 1046 (S.B. 1365), Acts of the 87th Legislature, Regular
12	12	Session, 2021, is reenacted and amended to read as follows:
13	13	(b) An open-enrollment charter school is subject to:
14	14	(1) a provision of this title establishing a criminal
15	15	offense;
16	16	(2) the provisions in Chapter 554, Government Code;
17	17	and
18	18	(3) a prohibition, restriction, or requirement, as
19	19	applicable, imposed by this title or a rule adopted under this
20	20	title, relating to:
21	21	(A) the Public Education Information Management
22	22	System (PEIMS) to the extent necessary to monitor compliance with
23	23	this subchapter as determined by the commissioner;
24	24	(B) criminal history records under Subchapter C,
25	25	Chapter 22;
26	26	(C) reading instruments and accelerated reading
27	27	instruction programs under Section 28.006;
28	28	(D) accelerated instruction under Section
29	29	28.0211;
30	30	(E) high school graduation requirements under
31	31	Section 28.025;
32	32	(F) special education programs under Subchapter
33	33	A, Chapter 29;
34	34	(G) bilingual education under Subchapter B,
35	35	Chapter 29;
36	36	(H) prekindergarten programs under Subchapter E
37	37	or E-1, Chapter 29, except class size limits for prekindergarten
38	38	classes imposed under Section 25.112, which do not apply;
39	39	(I) extracurricular activities under Section
40	40	33.081;
41	41	(J) discipline management practices or behavior
42	42	management techniques under Section 37.0021;
43	43	(K) health and safety under Chapter 38;
44	44	(L) the provisions of Subchapter A, Chapter 39;
45	45	(M) public school accountability and special
46	46	investigations under Subchapters A, B, C, D, F, G, and J, Chapter
47	47	39, and Chapter 39A;
48	48	(N) the requirement under Section 21.006 to
49	49	report an educator's misconduct;
50	50	(O) intensive programs of instruction under
51	51	Section 28.0213;
52	52	(P) the right of a school employee to report a
53	53	crime, as provided by Section 37.148;
54	54	(Q) bullying prevention policies and procedures
55	55	under Section 37.0832;
56	56	(R) the right of a school under Section 37.0052
57	57	to place a student who has engaged in certain bullying behavior in a
58	58	disciplinary alternative education program or to expel the student;
59	59	(S) the right under Section 37.0151 to report to
60	60	local law enforcement certain conduct constituting assault or
61	61	harassment;
62	62	(T) a parent's right to information regarding the
63	63	provision of assistance for learning difficulties to the parent's
64	64	child as provided by Sections 26.004(b)(11) and 26.0081(c) and (d);
65	65	(U) establishment of residency under Section
66	66	25.001;
67	67	(V) school safety requirements under Sections
68	68	37.108, 37.1081, 37.1082, 37.109, 37.113, 37.114, 37.1141, 37.115,
69	69	37.116, 37.207, and 37.2071;
70	70	(W) the early childhood literacy and mathematics
71	71	proficiency plans under Section 11.185;
72	72	(X) the college, career, and military readiness
73	73	plans under Section 11.186; and
74	74	(Y) [(X)] parental options to retain a student
75	75	under Section 28.02124.
76	76	SECTION 2. Subchapter D, Chapter 37, Education Code, is
77	77	amended by adding Section 37.116 to read as follows:
78	78	Sec. 37.116. EMERGENCY RESPONSE TRAINING. (a) A school
79	79	district may require each principal, assistant principal, school
80	80	marshal, school district peace officer, school resource officer,
81	81	and school security personnel employed by or assigned to the
82	82	district to complete the following emergency response management
83	83	training courses provided by the Federal Emergency Management
84	84	Agency:
85	85	(1) Introduction to the Incident Command System;
86	86	(2) Basic Incident Command System for Initial
87	87	Response;
88	88	(3) An Introduction to the National Incident
89	89	Management System; and
90	90	(4) National Response Framework, An Introduction.
91	91	(b) The board of trustees of a school district that requires
92	92	the completion of training courses under Subsection (a) shall adopt
93	93	policies to:
94	94	(1) verify completion of the training by each person
95	95	required to complete the training under Subsection (a); and
96	96	(2) provide annual emergency response management
97	97	training exercises incorporating the training required under
98	98	Subsection (a).
99	99	SECTION 3. To the extent of any conflict, this Act prevails
100	100	over another Act of the 88th Legislature, Regular Session, 2023,
101	101	relating to nonsubstantive additions to and corrections in enacted
102	102	codes.
103	103	SECTION 4. This Act applies beginning with the 2023-2024
104	104	school year.
105	105	SECTION 5. This Act takes effect immediately if it receives
106	106	a vote of two-thirds of all the members elected to each house, as
107	107	provided by Section 39, Article III, Texas Constitution. If this
108	108	Act does not receive the vote necessary for immediate effect, this
109	109	Act takes effect September 1, 2023.
