55 relating to the submission of certain reports by the Health and
66 Human Services Commission.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 531.06021(b), Government Code, is
99 amended to read as follows:
1010 (b) The [Not later than the 30th day after the last day of
1111 each state fiscal quarter, the] commission shall submit to the
1212 governor, the lieutenant governor, the speaker of the house of
1313 representatives, the Legislative Budget Board, and each standing
1414 legislative committee with primary jurisdiction over Medicaid a
1515 semiannual report containing, for the preceding six-month period
1616 [most recent state fiscal quarter], the following information and
1717 data related to access to care for Medicaid recipients receiving
1818 benefits under the medically dependent children (MDCP) waiver
1919 program:
2020 (1) enrollment in the Medicaid buy-in for children
2121 program implemented under Section 531.02444;
2222 (2) requests relating to interest list placements
2323 under Section 531.0601;
2424 (3) use of the Medicaid escalation help line
2525 established under Section 533.00253, if the help line was
2626 operational during the applicable six-month period [state fiscal
2727 quarter];
2828 (4) use of, requests for, and outcomes of the external
2929 medical review procedure established under Section 531.024164; and
3030 (5) complaints relating to the medically dependent
3131 children (MDCP) waiver program, categorized by disposition.
3232 SECTION 2. Section 32.155(e), Health and Safety Code, is
3333 amended to read as follows:
3434 (e) The commission shall [may] submit the report required
3535 under Subsection (d) with the report required under Section
3636 536.008, Government Code.
3737 SECTION 3. Section 255.005, Health and Safety Code, is
3838 amended to read as follows:
3939 Sec. 255.005. REPORT. (a) The Health and Human Services
4040 Commission [department] shall assess and evaluate the
4141 effectiveness of the quality assurance early warning system and
4242 shall report its findings annually to the governor, the lieutenant
4343 governor, and the speaker of the house of representatives.
4444 (b) The Health and Human Services Commission shall submit
4545 the report required under this section with the report required
4646 under Section 536.008, Government Code.
4747 SECTION 4. If before implementing any provision of this Act
4848 a state agency determines that a waiver or authorization from a
4949 federal agency is necessary for implementation of that provision,
5050 the agency affected by the provision shall request the waiver or
5151 authorization and may delay implementing that provision until the
5252 waiver or authorization is granted.
5353 SECTION 5. This Act takes effect September 1, 2023.
