5	5	relating to the submission of certain reports by the Health and
6	6	Human Services Commission.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 531.06021(b), Government Code, is
9	9	amended to read as follows:
10	10	(b) The [Not later than the 30th day after the last day of
11	11	each state fiscal quarter, the] commission shall submit to the
12	12	governor, the lieutenant governor, the speaker of the house of
13	13	representatives, the Legislative Budget Board, and each standing
14	14	legislative committee with primary jurisdiction over Medicaid a
15	15	semiannual report containing, for the preceding six-month period
16	16	[most recent state fiscal quarter], the following information and
17	17	data related to access to care for Medicaid recipients receiving
18	18	benefits under the medically dependent children (MDCP) waiver
19	19	program:
20	20	(1) enrollment in the Medicaid buy-in for children
21	21	program implemented under Section 531.02444;
22	22	(2) requests relating to interest list placements
23	23	under Section 531.0601;
24	24	(3) use of the Medicaid escalation help line
25	25	established under Section 533.00253, if the help line was
26	26	operational during the applicable six-month period [state fiscal
27	27	quarter];
28	28	(4) use of, requests for, and outcomes of the external
29	29	medical review procedure established under Section 531.024164; and
30	30	(5) complaints relating to the medically dependent
31	31	children (MDCP) waiver program, categorized by disposition.
32	32	SECTION 2. Section 32.155(e), Health and Safety Code, is
33	33	amended to read as follows:
34	34	(e) The commission shall [may] submit the report required
35	35	under Subsection (d) with the report required under Section
36	36	536.008, Government Code.
37	37	SECTION 3. Section 255.005, Health and Safety Code, is
38	38	amended to read as follows:
39	39	Sec. 255.005. REPORT. (a) The Health and Human Services
40	40	Commission [department] shall assess and evaluate the
41	41	effectiveness of the quality assurance early warning system and
42	42	shall report its findings annually to the governor, the lieutenant
43	43	governor, and the speaker of the house of representatives.
44	44	(b) The Health and Human Services Commission shall submit
45	45	the report required under this section with the report required
46	46	under Section 536.008, Government Code.
47	47	SECTION 4. If before implementing any provision of this Act
48	48	a state agency determines that a waiver or authorization from a
49	49	federal agency is necessary for implementation of that provision,
50	50	the agency affected by the provision shall request the waiver or
51	51	authorization and may delay implementing that provision until the
52	52	waiver or authorization is granted.
53	53	SECTION 5. This Act takes effect September 1, 2023.
